We first met this customer after she got our number from Angie’s List. On April 4th, 2013 we looked at her hall bathroom and gave her an estimate for tiling the floor with tile base. The customer stated that if this went well then we could do the master bathroom remodel. We completed the task on April 15th and 16th and were paid for the guest bathroom. After about a week, the customer called about a grout touch up, tile at doorway, threshold, and some inconsistent color on the floor. We came back to her house on April 25th and looked at her concerns and she asked us for 3 more estimates for fencing. We did take care of some concerns that day and scheduled to come back and complete the other issues on May 25th which was a Saturday. The customer was aware that we only do one job at a time and so we had to schedule her when we didn’t have anything else going on. At that point she was already complaining that she had to wait, but yet she knew how we did our schedule. On May 25th we did complete and finish all issues she had with her guest bathroom. She was very pleased. We had already scheduled the master bathroom for a start date of July 1st, 2013. We had gone over the contract in detail as we do with every job. Everything is laid out in our estimate verbatim to what we will be doing, as well as the allowances for tile, fixtures, and door. When we first discussed shower doors, the customer stated she wanted one similar to what she already had, the allowance being in accordance at $250.00. After most of the shower tile was installed, the customer decided on something different for the shower door so we contacted Metz Glass and AAA Glass on July 19th, 2013. This way she would not be able to see her options. She chose a 150 lb. 3/8 thick tempered and frameless door. This is NOT what we first discussed. She wanted the door and was willing to pay the difference that was over her allowance of $250.00. We set it up with Metz Glass that we, Sunrise Remodeling, would pay $250.00 and the customer would pay the difference. All three parties were in agreement to this set up. We kept a steady pace daily with many trips to Lowes and dry time being needed. During this time period the customer regularly purchased lavish gifts for my wife and would invite us daily to swim naked in her pool with her. She would say, “Y’all are like family now so it’s no big deal if you swim naked!!” Of course we both refused each time, but it was very difficult to work for her knowing she was trying to see us naked. The customer was very nice to my wife. My wife would occasionally go shopping with the customer at the PX, commissary, and thrift store. Not only did she buy my wife lavish gifts but DAILY would try to send home a 6-pack of German beer for me to drink. I refused every time and never drank on the job. When it came time to set the tub, we realized it was going to be a tight fit. So I offered to move her closet walls so it would fit the way she wanted it to. ( I did this at NO charge to her). The customer did have wallpaper on her walls which meant once I moved the walls the wallpaper would be no good. I explained this to her and told her that I would only charge her $400.00 to remove wallpaper, prep, patch, finish & paint walls & trim (2 coats), so NO charge for moving the walls. She agreed and paid the $400.00 immediately & we added it to the bottom of the original contract. These walls were non-structural with no electric. After moving the walls we came in the next morning to find she had turned the tub, making ALL the work for NOTHING!! This also caused the job to be delayed considerably because we were not planning on moving walls and painting. During this time she was complaining of having issues with a roofer. The customer stated to me that she was going to give him a bad review, then looked at me and said, “But Billy is not going to get a bad review, we know what he is going to get. I felt very threatened by that statement. When it came time to layout her tile I got her involved and we decided on more than one row of deco’s and went with three rows along with some pencils to outline it with. In installed the extra tile at NO CHARGE because I was very excited about how it was going to look. I only Asked her to but the pencils and I would supply the rest of the glass, since I already had it on site. One think that I did not realize is that she was keeping all the old brass in her bathroom, so when I installed the shower cover I used brushed nickel like I use in all other bathrooms. I was going to change cover from silver to gold at a later time. We were nearing the end and the paint was on the walls and the customer walks into the bathroom with two lights she had purchased. She doesn’t ask us to install them. She leaves them in the bathroom with the expectation that we will do it. Yes I did install them to keep her happy. Her vanity did have a chip on the front of it and I do not know if we did it or not during demolition. But I did offer a remedy and she accepted. I trimmed the bottom with a piece of stainable molding. The next day I came in the customer had removed the molding I installed and installed some she bought which was almost like what I had. The major difference was she had used an off color stain. I told her that I would have swapped it out for different design if she hadn’t like what I put on there. On the last day of major work the customer stated she did not like the right wall beside the tub. She was right, it was a little rounded. So we fixed the wall. Pictures will show that it looked good. I told her that because of the corner beads it is natural to have some curvature. She still was not happy. She wanted me to redo the entire wall over. Prior to the discussion about the wall, the pictures will show that she was using her new bathroom regularly and was happy. During this time my wife found out that he aunt was dying (and did die August 2nd, 2013) so she had to leave town. The customer suggested that I come back and do the last of the touch ups when Steph came back and the shower door was ready. I wanted to come and complete it but I was scared to be at her house without my wife there, so I agreed. We received a call from Metz’s Glass on August 9th, 2013, that the customer’s door was ready and they wanted to schedule installation. Metz’s glass does not schedule before installs unless they know for sure who is paying the bill. My wife had just gotten home the night before. Steph knew the customer would be home because the customer had called my wife everyday she was gone except August 7th, 2013. So I adjusted my schedule to be at her house and Steph called her to tell her we would be there Monday, August 12th, 2013, to complete touch ups and Metz’s to install shower door. The customer was excited and said she couldn’t wait to see my wife, since she had been gone a week dealing with funeral arrangements for her aunt. My wife and I showed up Monday morning at her house and got things rolling for her door. The customer had another gift for my wife. Steph stayed for a little bit but had to leave for an appointment. Meanwhile, I had to do some notches in the tile for the new shower door. It went well. I continued to work on my paint touch ups while Mr. Metz worked on the shower door. While I was working the customer came into the bathroom and asked where Steffy went. I told her that She had an appointment to get her hair done. This seemed to irritate the customer. The next thing that she said to me shocked me. The customer said to me, “Why don’t you come back another day, so Steffy can be here.” I told her that I needed to finish that day! So she left from the bathroom. Short time later we found out that the shower door was not going to work. There was not enough blocking in the wall to support such a heavy door. At that point I told Mr. Metz to go ahead and leave and I would get the blocking put in the wall and call him when it’s done. I called the customer into the bathroom and explained to here that there is not enough blocking in the wall for her shower door. As soon as I did the customer asked me if this was going to cost her extra. At that point I told her yes, but that we would talk to Steph when she got back and figured it out. The customer agreed. After I finished the walls and other paint touch ups I decided to take a lunch break. I told the customer that I was going to lunch because we had some dry time before I could do anything else. She said OK. When I returned about an hour and a half later, the customer’s husband met me in the driveway and said in a VERY LOUD voice, “Billy, your time management skills are SH*T.” I immediately looked at him and said I am leaving and I will be back when Steph can be here, that way she can help us work through this. I left over $1,000 worth of tools there FULLY intending to work this out. I was scared to be there by myself because the customer’s husband seemed very angry and had insulted me. Within an hour and a half of me leaving the customer’s residence the customer had called Metz glass to ask them if they knew anyone that could complete their bathroom because I had walked off the job. Metz glass called my wife and told her what the customer had done. The customer refused to let us complete the minor items, and furthermore, refused to give us our tools back. The customer stated that they were keeping our tools until the matter was resolved and demanded $5,000. The customers thus breached our contract and converted our tools.
