Description of Work: We have been trying to get a loan modification since February 2009 (what a trying ordeal). Time is running out. A foreclosure statement came in the mail one day last week. So we wanted to look into doing a short sale and checked Angie's List for a realtor that did short sales. I could not find any, so decided to call Brian Passarelli, who had excellent reviews across the board on Angie's List, to see if he could give us any direction. He sent us to a colleague of his, Jack Oudin who specializes in short sales/foreclosures and a number of other areas in real estate. Jack came to our house (soon to be added to the thousands of bank owned houses in North Carolina), with a folder containing printouts of all the information from POLARIS (Property Ownership Land Records Information System), listings of houses that sold and are for sale in the subdivision, Comparative Market Analysis, listing of a short sale he has pending, a listing price worksheet and his wealth of knowledge. He explained how the short sale process would go in our situation thoroughly. We set up a meeting with Jack for the weekend to sign the papers to get the short sale process going. The next day we got an email from him informing us of the hearing and sale date of the foreclosure on our house. I wondered how long the dates had been set and when the bank’s attorney was going to let us know. Thanks to Jack's due diligence we decided our time for a short sale was too risky and, as with foreclosure, we were concerned with having to pay a deficiency. We are in the process of filing for Chapter 7 to limit our damages and will be able to keep all our possessions (because the value does not exceed the NC property exemption limit), except the house, and get rid of our unsecured debts and the harassing collection agencies. It would take years to pay off all the debt, and our credit is shot anyway; this will be like a fresh start; no debt, no credit (having too much credit helped get us into this situation in the first place).
