Mr. Burr breached the contract and did not perform the work.
Description of Work: We entered into contract with Rich Burr, owner of this company to build an 8 x 10 shed for $3752. We paid him a deposit of $2652. Mr. Burr stood in our home the afternoon he collected his down payment and told both my husband and I the shed would take two days to build and he would be starting in 2 weeks. He further told us it would most likely be sooner, but he wasn't sure about the weather so he gave us a date 2 weeks out. He thanked us for the business and said "no job is too small". As he was leaving he said he would be calling DigRite right away to have the utilities marked.. We paid our deposit on 4/27/12 and the start date would be 5/14/12. We did not hear from Mr. Burr, DigRite did not show up, so on 5/9/12 I called him. Mr. Burr told me the job had been purshed back due to rain. Glad I called to find out. During the call Mr. Burr said he would be calling DigRite the next day. This was not consistent with what we were originally told. Then two days later I get a text from Mr. Burr, no phone call, telling me he had called DigRite and they wouldn't be able to get to our house for 6 days, once again delaying the job. I picked up the phone and called Mr. Burr to ask what was going on. Mr. Burr was quick to let me know he was just the victim of circumstances out of his control. He told me it never takes them over 24 hours and he didn't know what was going on. Mr. Burr also told me the shed was now going to take a week to build, not the two days we were originally told. I told Mr. Burr I was frustrated he hadn't called them sooner like he said he would so this delay would not have happened. I asked Mr. Burr when he called DigRite (5/10 or 5/11), he said he called 5/10 just like he said he would on our 5/9 phone call. Then Mr. Burr responded, well I can't work for someone who is frustrated so I think I better give you your money back. This caught me off guard so I discussed the reasons for my frustration and how anyone would feel the same way based on the circumstances. Mr. Burr calmed down and agreed to call me the following Monday with a start date. Then over the weekend Mr. Burr sent me an email (again he did not call), tell us he couldn't do the job because I had been frustrated and he would be mailing our deposit back on Monday. We emailed Mr. Burr stating we felt the way he was handling this was very inappropriate. Mr. Burr began sending a flurry of emails, we ended up with 7 before he was done. His emails contained insults and very innapropriate acusations. I collected them all because they began to become harrassing. My husband waiting until Monday to respond to Mr. Burr, after he took the time to call DigRite himself. It turned out Mr. Burr didn't call DigRite until 5/11, in the afternoon and had been advised they would be done in 24 business hours. Again, completely inconsistent with what Mr. Burr had told us. My husband emailed Mr. Burr on Monday and clearly demanded his money be returned to him by Wednesday or he would pursue the interest he was losing (3%). Amazingly, Mr. Burr wrote back to us again and said once again he was just the victim. His secretary told him she called DigRite on Thursday, not Friday, and it was going to take six days. He was just passing along the information she gave him. He was not responsible. He also made it clear he did not like being threatened and he had experienced losses from the job. Clearly Mr. Burr does not understand contractual law. He created his own losses when he breached the contract. Further, Mr. Burr needs to understand, when he takes a clients money and does not intend to do the job, the person is going to demand their money be returned. Mr. Burr took no responsibility for anything related to this job. Mr. Burr was a victim of the weather, DigRite, his secretary, my frustration, you name it, he was the victim of it. Mr. Burr stated he didn't call to cancel the job because he was afraid of me lashing out at him. Mr. Burr sent very childish emails when he sent the flurry of them that really made no sense. Overall he sounded like a scared little boy in them. When it came to anything difficult Mr. Burr either text or emailed. Mr. Burr was recommended to us by Exterior Business Solutions. This was the first time they had referred him. I called them to tell them what had happened and it will now be the last time they refer him. I strongly discourage anyone from entering into contract with Mr. Burr or Legacy Contracting LLC.
