My story is a story of the utmost regard for the contractor and friend I came in contact with in 2011. BeIow is my story.... I grew up every summer from Memorial Day to Labor Day at our family cabin on Pequaywan Lake. The cabin was an incredible place for me and my family. It was where I learned to: swim, ride a bike, water-ski, and where my friends and me could just be a kids. My dad was a construction worker who was always doing a project at the cabin every summer, and took great pride in the work he did. In 2011, due to some health issues, my dad gave me the cabin that our family loves so much. When I received the property, it was in complete disrepair: downed power-lines, broken windows, leaking roof, and a number of other issues with the property. As I was asking around the area for someone that I could trust our family property with, there was a resounding answer: John Lucia. It was the summer of 2011 that I first met John. I spoke with him over the phone about the work that needed to be done and arranged a time to meet. We met on a Saturday as I had to come up from the Twin Cities (180 miles away). I was thrilled with his flexibility in meeting me on a weekend. John came out to the cabin and spent about two hours listening to me and the vision I had for the property. The first order of concern was a downed power line and ripped off fascia. I had originally talked about just fixing the fascia and re-hanging the power line. John listened to me and gave me an alternative option of burying the line so I would never have to worry about a tree falling and the power-line ripping off the cabin again. He bid out both options and we ultimately decided on burying the line. I appreciated that John gave me alternative options for the work that I hadn?t thought of; this is a theme that has carried on through all of the work I have asked him to do. The line work was done on-time and was done in such a way that was meticulous and careful. I was impressed with his work. So impressed that I asked him to help me with some of the other ideas I had for the cabin. I have spent the last three summers working with John. Many hours I have been spent with him and his ?iPad? (a yellow legal pad of every note we discuss) to make sure the bids are reflective of the vision I have and the work that John needs to do to bring that vision to life. To date, I have had John: re-wire the entire cabin; insulate the attic; install tongue and groove wall board; new ceilings; windows; stone veneer on the foundation; and tongue and groove ceilings in our guest cabin. He is currently working on siding and new flooring in the cabin, which is anticipated to be done the first week in July. I couldn?t be more thrilled with his work. John is a craftsman. He has impeccable attention to detail and really takes pride in making sure the finished product is perfect. I am a very detailed person and can be a really tough customer. John and I have checked in all along the way on each project he has done. He asks multiple questions so we are absolutely on the same page so any things that might come up are quickly rectified. This is really nice since I live 3 hours away from the lake and always feel like he and I are on the same page. I am typically impressed above my own expectations on how something turns out. I have a lot of trust in John. I mentioned my dad and my family early on in this letter. Dad is now healthier. I have wanted to create a space where he and mom can come, relax, and be with the family that they are so proud of. My mom, dad and the rest of the family have been up many times since John has started working with us, and, each time, the entire family is incredibly complementary of the work he has done. My dad, who is the ultimate critic, is very impressed with everything that John has done. He often looks at the new tongue and groove wallboard and admires the cuts and the framing of the windows in each room. This ?inspection? goes on each time he is at the lake and each time he tells me and mom how all of our dreams of what the cabin would look like have come true. He is right. . . and I thank John Lucia for this. Please consider this a strong vote of my utmost confidence in the work John has done. I am happy to talk to anyone about his work and the time we have had over the last three years creating memories for my family and me.

John Lucia of John Lucia Construction assessed our property before the construction project started. We (my wife and I) and Mr. Lucia agreed to and signed a contract on 5-12-2013 for him to construct 2 individual 8'x10' decks to be attached to one side and at each end of our lake home. The contract included a list of materials to be used in the construction of the decks. We also agreed, weather permitting, that Mr. Lucia could construct the decks while my wife and I enjoyed a 2 week vacation away from the area. Beings Mr. Lucia lives very close (2 miles) from us, we (mistakenly) trusted him to do what we had agreed to. Shortly after we returned from vacation we realized the 2 decks had been constructed of smaller (inferior) material than we had agreed to. Where 2x10 inch lumber was to be used (rim joist, joists, and framed beams) Mr. Lucia substituted 2x8 inch lumber. He poured 8 inch cement piller footings instead of 10 inch and he also narrowed the width of the 11 step stairway by 6 inches to 42" instead of 48". He did all these changes without our approval or knowledge! When I mentioned these discrepancies to him he said the changes he made were still within codes and he had "made up" for the cost difference by "inhancing" the looks of the decks, then he would quickly change the subject. Prior to the start of the project we had paid Mr. Lucia 1/2 the total cost of the project when the contract was signed. After the completion of the project my wife and I decided the best way to address our displeasure and unsatisfaction, again, was in writing. We paid him the final 1/2, after all, he did have his expenses to pay. Along with the final payment we included a letter listing our complaints. At that time we figured Mr. Lucia as a caring businessman and some what close neighbor and would want to contact us to discuss our complaints and/or offer us some sort of agreeable compensation. However, to this day Mr. Lucia has not personally contacted us. He no longer even acknowledges my presence when we see one another within our local area. Guilty conscience? My wife and I ordered and paid for something we did not get from this contractor. Yes, we do have 2 decks but they are not built as we specifically ordered. Now, because of the modifications and inferior materials he used, we can no longer consider putting a small 2 person hot tub/spa on either of the decks. A possibility we had discussed with Mr. Lucia before the contract was signed. In closing, my wife and I have given Mr. Lucia ample time to correct his wrong doing. We feel cheated and taken advantage of by him because we went on vacation and were not at our home to "watch over" this licensed professional contractor's work. We feel Mr. Lucia should correct his unauthorized modifications or as an alternative, to at least issue us an agreeable partial refund. Until he satisfactorly addresses our complaints, with us, We feel responsible to notify others about him and his business. I will continue to give my facts and voice my opinions through reviews and recommendations in hopes others will not have to deal with this same unfortionate ordeal.
Description of Work: John Lucia, representing John Lucia Construction built two (2) 8'x10' decks for us, (my wife and I). Both decks were constructed on the same side of the house but at each end and aprox. 8' above level ground grade. He failed to obide by and/or use the agreed materials (he used smaller and/or inferior materials) and did not offer or give us any compensation. In our opinion, he breached our agreed to contract. Update: On July 10th, 2014, the 6th District Court of St. Louis County in Minnesota, Order for Judgement, was made "against" the Defendant, John Lucia Construction (service provider). The Courts Order was for the Defendant to compensate the Plaintiff, my wife and I, with a refund and also for him to pay our court fees. Although this case (court file # 69DU-CO-14-470) has finally ended, it was a long enduring and uncalled for inconvenience bestowed upon us by this inconsiderate to "our wants" and/or "our rights" service provider.

Please see attached letters sent to the Minnesota Attorney General’s and Minnesota Department of Labor and Industry. In addition, I would like to state that I had been more than willing to work with [member name removed]. In fact after the job was complete I went to their residence to complete a punch list of items [member name removed] wanted done to complete the job. [member name removed] told me and one of my employees that the decks look great and that he was totally satisfied with our work and would send payment in full – which he did. After the punch list was complete and payment was made [member name removed] then contacted the Minnesota Attorney General’s office demanding a $2,690 refund on the job. He also went to one of my suppliers demanding confidential John Lucia Construction account information and when the supplier refused [member name removed] made threats to sue the supplier. It was after these actions on [member name removed] part that I got some legal advice and was told that I should not have contact with [member name removed]. The [member name removed] have been very unreasonable and have forced us to defend ourselves and business from their threats and allegations. Also – with regards to [member name removed] statement regarding a hot tub on the deck – prior to starting the work or signing the contract I explained to him that the weight of the hot tub cannot be put on the decks not because of the construction of the decks but due to pre-existing conditions of the cantilevered floor already holding up too much weight of the roof and floor. After I explained this to him the topic of a hot tub was not discussed again. John Lucia Construction, LLC 8835 Pequaywan Lake Road Duluth, MN 55803 July 15, 2013 Mr. Kyle Nessen Office of the Minnesota Attorney General 445 Minnesota Street, Suite 1400 Bremer Tower St. Paul, MN 55101-2131 RE: [member name removed], File #KAN/2013/490444/C Dear Mr. Nessen, May 12, 2013 we signed a contract with [member name removed] and agreed to start on May 23, 2013 with a deadline of May 31, 2013 as per homeowner’s request as they would be out of town on vacation and would like it to be complete in that timeframe. We requested a key for the house to have access to the electric panel or for any other situation that might require access. We also requested a phone number in case we needed to contact [member name removed]. We started the project on May 23. Because of the sever incline of the property we were unable to use heavy equipment to auger the four footings which caused us to use a hand auger. The only one available to rent came with a 12” auger which does not give enough clearance to properly align a 10” column form so we downsized to a 8” forms which are completely within U.B.C. specs. As we prepared to hand-mix the concrete for the columns we noticed the outside faucet was shut off and the key for the house that the [member name removed] gave us did not work. At this time we tried to contact [member name removed] by phone – with no response. After a two hour delay their neighbor returned home and kindly allowed us to use their water to mix concrete. May 24, 2013 we prepared to install deck ledger board, at this time we noticed the old deck framing and ledger attachment point were not properly prepared as the homeowner promised to have ready. This required additional man hours by John Lucia Construction. We then continued building the decks – at this point we calculated the join size and found a 2” x 8’ SYP joist spanning 8’ was more than sufficient to meet the U.B.C. specs and the same time allow a 1” x 12” cedar fascia to be applied to give the deck a more finished look. At this time we made another call to [member name removed] – again with no response. We then carried on with our plan to change the joist to 2” x 8’ and install the cedar fascia at no additional cost to the homeowner. May 28 we continued building the deck. May 29 we installed decking and railings. May 30 we started the framing of the stairs. After measuring the width of the stairs and the space that was available we noticed that because of the sever incline of the hill we had to move the steps closer to the house which would not allow for the 36” walkway between the house and stairs. At this time we tried to contact [member name removed] – once again with no response. We then decided to make the stairs 42” wide instead of 48” to give [member name removed] the requested 36” clearance to the house and still have a very generous 42” staircase. We believed this would be a reasonable compromise based on the conditions. After hours [member name removed] finally contacted me. I briefly explained to him over the pone the changes we had made but since they would be home the following day we could discuss them in detail at the site. End of call. June 1, 2013 – homeowner completes inspection of decks and would like to meet to discuss changes and give me a punch list of items. I assured them I would make any and all changes in order to have them 100% satisfied with the work. We then agreed to return and make all the changes requested. June 7, 2013 – returned to site and completed all items on punch list. After completion of the project, [member name removed] said he was happy with the work and replied that it looks very nice and will send the final payment. I shook hands with [member name removed] and we left the site. June 8, 2013 - [member name removed] hand delivered the final payment to me at my residence. I shook her hand and said thank you for the work and I hope you enjoy your new decks – she then left. Not until I read the note enclosed with the final payment did I know that she was not satisfied and I have not had any further contact with her. In closing, I believe that I did everything in my power to be sure the project was complete, on time, using best build practices and even gave them some quality extras at no charge. Please feel free to contact me at any time as I would like to resolve this matter as soon as possible. I have been in business since 1986 and I have never had a situation such as this. I would, however, look at something more reasonable as a solution as I do not want an unhappy customer. Thank you for your help. John J. Here is my response to each item: Item #1 – Yes, we did assess the property before submitting a construction agreement as we always do. However, changes in the scope of work are very common and we did our best to contact the [member name removed] with no response. Item #2 – The construction agreement was complete and signed when they requested t hat the work be done during the two weeks they would be on vacation – we Verbally agreed to have the work complete before their return and did not think it was necessary to be in writing. Item #3 – The request of $2,690 was a surprise to me and I did not know of this request until the receipt of your first letter dated July 12, 2013. We described in detail the changes that were made along with the additional work we had completed for the [member name removed] as per their request and left the site on good terms with [member name removed] stating he was satisfied and that the work was very nice and the final payment would be sent. I feel the refund of $2,690 in unreasonable – also the [member name removed] did not contact me to discuss any issues they may have had before contacting your office and the office of Department of Labor and Industry. I am a very reasonable man and would have been more than happy to discuss these matters with the [member name removed] at the completion of the project. However, due to their actions – including attempting to obtain personal account information from my suppliers I feel I need to protect myself and business from these unreasonable accusations and request from the [member name removed]. Because of the [member name removed] actions I have been advised to have no further contact with the [member name removed]. In closing I would like to state that all the work completed was done in accordance with the State of Minnesota Residential Building Code and the IRC and the difference in cost for the changes with the additional work we had to complete partially due to the [member name removed] not having completed the work they agreed to have complete prior to the start of our job out to be $427.00 in their favor.
