DISCOUNT WINDOW

Had a friend who does carpenter work help with windows for a four season room in my house. After many discussions with Discount regarding style, sizes, installation, etc, we ordered windows from Discount Windows & Eric Pierson (owner) on Aug 13, 2009. Agreed to half down and remainder on delivery for payment. Was told the windows would arrive in about two weeks. Contacted Eric 9/4/09 for status and was told they were not ready and it was going to be another week or two. Contacted by Eric 9/8/09 stating the windows were ready and they would be delivered Thurs 9/10/09. No show. Contacted Eric and left a message. Did not hear back until 6pm that night stating he was running behind and he would deliver Friday. No show. Contacted Eric, he stated that axle broke on trailer and asked to deliver Saturday morning. Did not show until mid afternoon Saturday. While unloading windows, noticed that the sizes were not correct. I let Eric know this and showed him the spots for the windows to be installed. He stated he would need to talk to manufacturer to see what he could do and asked if he could leave the windows because he didn't want them damaged because they were in the back of his truck instead of his trailed. I reluctantly agreed with the understanding that Eric was going to contact me Monday. After not hearing from no one on Monday 9/14/09, I left several voice messages and sent a fax requesting status. On 9/15 called and talked with a different person and they wanted to send me a fax. Received a fax from Discount, signed by Eric stating that sizes we faxed to him were what was ordered. Unknown to us was the method that which windows are measured, which is 'width x height' not 'height x width' and we were basically stuck with the windows. After several phone calls and letters over several weeks, trying to come to some to a solution to this problem, I finally contacted my attorney. My attorney contacted Eric on 11/13/09 to discuss this issue and to come to some solution to this problem, which Eric stated he would contact my attorney on Monday 11/16/09. Discovered later that afternoon that Discount window charged my credit card the remainder of the cost of the windows. On 1/27/10, attorney sent letter of intent to Discount windows. No response. Feeling that I had no other choice and have had absolutely 'no' contact from Eric Pierson except one fax, we filed a lawsuit at the 59th District Court, Case 11-0618-CG against Discount Windows in March 2012 and the court ruled in our favor. Discount was ordered to pay $2058 for illegally charging my credit card, cost of the windows and attorney fees. After receiving no payment from Discount Window, I turned the judgement over to a collection attorney in Nov 2012. After receiving approximately $400, Discount Window/Eric Pierson filed bankruptcy Aug 2013. I never wanted this to go this far and was willing to work with Discount Window to come to some fair solution but now I have 7 incorrectly sized windows, a loss of over $3000 and a huge amount of lost time with this whole fiasco. Very disappointed.

They were the first ones my husband called to come over. They were very good. They kept in contact with us when they ordered the windows. There were some problems with the windows when they ordered them. They called to let us know what the problem was. It was the manufacture's problem. You wouldn't get upset that you're waiting because they keep in contact with you and let you know what was happening. It was supposed to be two guys doing the windows but unfortunately the day that we were supposed to have them put in the windows both were sick. So it was the owner of the company that came and did them by himself. They are very professional and very nice people. My husband helped him with one window because it was big picture window on a second storey. He did give us a discount because he helped him. We are having them coming back to replace the rest of our windows now.
