We followed the protocol for non-renewal as outlined in the lease, and in the paperwork they gave us. The townhouse was cleaned as per their instructions, and the keys were surrendered June 17, 2011; three days before the lease ran out. Jocelyn and I married the next day, and were on our honeymoon when the lease actually ran out.As per Maryland law, the agency had 45 days to settle our security deposit. It should be noted that we were on our honeymoon and we did not return until late on the 26th, when they already inspected the premises,and were advertising for it to be filled by July 1st. We did not receive our security deposit for over four weeks, and visited the office July 21st. Mary Anne was vague, and said the checks would be sent out shortly. We received it Saturday, July 23rd. Of the original $1,342, we only received xxxxxxxxx. The escrow account accrued $80.00 in interest, and they subtracted $600.00 for alleged painting/wall damage fees, and $150 for cleaning. The last of the water and sewer bill was also subtracted, which we are not contesting. In addition, we privately, as per the lease, had paid for professional carpet cleaning to the tune of $100.When we returned to dispute the amount, Mary Anne ignored our complaints, and made us set an appointment for later in the week to discuss the issue. They allegedly have a video of the apartment that they took during the walk through, while we were on our honeymoon, but refused to show it to us until another time.Our dispute lies in the fact that there was no damage to the apartment, other than typical wear and tear. The apartment had been empty a year prior to occupation, and we followed all of their rules in the lease. We never hung pictures, or put holes through the drywall. After we cleaned, we noted only three places where the wall was in any way nicked, and it was only slightly (certainly not $600 worth of damage). Because we cleaned to their specifications, we are also disputing the cleaning charge. The procedures are outlined in the lease, and we followed them precisely. After researching recent case law, and Maryland code regarding normal wear and tear, I feel that Eric Davis is responsible for any repainting due to the age of the building, and normal wear, tear, and fading.I have lodged a complaint with the Mayor and county council, as well. I do not want to have to resort to small claims court, as it is not cost effective to do so. I simply want for Eric Davis to do the right thing, and reissue a check for the complete security deposit amount, minus the water and sewer bill.
Description of Work: I established a lease with Eric Davis on June 10th, of 2009 at 1703 Woodbrooke Drive. I had just left the Marine Corps, and was looking for a place to live while I used my GI benefits to attend school. These townhouses were built the year prior, and had been empty until recently. I was the first tenant on my row to occupy these townhouses. I left a security deposit of one and a half month's rent, for $1,342.50, and received a receipt, as per law. In June 2010, I renewed this lease with my then-girlfriend (now wife) Jocelyn (Hensley) Armes. We lived there for a year, and notified the property manager, Mary Anne Johnson, that we would not be renewing our lease.
