The Customer, lives in an end unit townhouse in Germantown, MD, she has 10 shutters at the front of the house and a front entrance door, both painted blue. On the end unit gable side of the she has two doors situated approx 45 feet from the ground on the side of the building, they are painted White In the Fall of 2011, the Customer approached me while I was painting her neighbors house and asked me to give her an estimate to paint the shutters and the front entrance door at the front of her home, at this time she made no mention of the doors at the side of her home, as requested later that evening, I provided her by email with a written estimate for the work, the estimate was for a total of $410.00. A couple of days later again while I was painting her neighbor’s house, she approached me and authorized me to do the work, she asked if I would discuss colors with her. The shutters and the front entrance door to her house were badly neglected, the sun had faded all color out of both, I informed her that normally I would remove a shutter and have it matched, but due to the condition there was longer any color on the shutters or the door to match, I provided her with 2 separate Benjamin Moore color wheels, 2 separate Duron color wheels and a McCormick color wheel, after about an hour SHE selected a color, at this point she made comment about how I was going to get up to the doors situated on the side of her house, I informed her that my estimate was for the front of the house only, she had not asked me to paint any part of the side of the house, she asked me if I would paint the side, at no extra cost as part of my original estimate, I informed her that due to the height from the ground (45 feet), and the doors being a different color White as opposed to the blue, I could not do as she requested, I offered her a separate estimate for the additional work, but she declined, at this point we had not done any work on her house and told her she was free to obtain estimates from other companies also working in the area at the time, she told me proceed with the work listed on my estimate . As stated by the Customer, my Painter Jeff and a helper painted the shutters and front entrance door, at this time she stood outside and watched him paint both, at no time did I do any painting, she appeared to be satisfied with the color and the quality of work. At no time did I state the paint would darken when it dried. Jeff is my painter he is not in a position to issue receipts, or guarantees. An invoice for the work was emailed to her. In the Spring of 2012 the Customer left a message on my answering service stating that she was not satisfied with the color of the shutters and the front entrance door, I called her back and discussed the color we had used, she said the color was too light and did not match the original color that was used, I reminded her of our conversation in the Fall where I made it clear to her I could not match the color due to the condition of the door and the shutters, she told me that she wanted the color to be darker, I told her that as a service to her I would return and re paint the shutters and the front entrance door, I informed her that she would need to go to the Benjamin Moore paint store in Germantown MD, select a color she considered suitable, tell the store I was doing the painting, allowing her to get a discounted price on the purchase of the paint, she told me she would not purchase the paint, it was my responsibility. I informed her that I was under no obligation to re paint the areas concerned, I was only doing this as a service to her, she selected the color not me, I painted with the color she told me to paint with, I was willing to pay the labor costs associated with the repainting, and that it would be fair that she buy 1 quart of paint at my discounted price, she refused and began threatening me saying “ I will take this further”, I told her to contact me if she changed her mind. After a few weeks she contacted me again telling me she had the paint and wanted me to re paint as soon as possible. I arranged to meet with her in the afternoon at 1pm when we turned up she did not answer the door. With the Customer’s work schedule it is very difficult to get hold of her. We eventually got in touch with her and I informed her that I had existing commitments. I scheduled the work to be done in 2 weeks. On commencement of the work, she again stood outside the whole time and watched my painter and helper paint the shutters and the front entrance door, she said she was happy with the color and the quality of the work, she asked my painter if he would install a kick plate to the front entrance door, he informed her that he was only authorized to do painting, if she wanted anything else done she would have to speak to me, she did so and I told her that before we could install anything the paint on the door would need to dry and cure, approx. 1 week, I told her to call when and I would arrange to have the plate installed, again as a service to her at no charge, to date she has never called, I assumed she had installed it herself. The Customer’s allegations are completely unfounded, the original work and color met with her approval, at the time, after a lengthy period she decided the color SHE selected was not suitable, and to avoid any bad feeling I agreed to provide the labor to redo the work, again at this time the color and quality of work was to her satisfaction, she has never contacted us to voice any negative comments. I find it hard to believe that the Customer touched up the areas she said were missed, as she suggested, my painters used a 40 feet ladder to paint the front of her house, and if she installed the kick plate on her own, why did she ask me to install it for her. I have been nothing more than courteous in my manner to the Customer in all my dealings with her. Another copy of her invoice will be mailed to her.
