A few years ago, I hired him to install a new air conditioning unit. It’s been having problems since he installed it. The air conditioning unit hasn’t been fixed. He’ll tell me that it’s working, but it’s not working. I re-hired him to do some work in the basement after a flood; drywall and painting. He came out and did the work, but he did a pretty crummy job. There are seams that are visible where the new drywall & the old drywall is attached; he just painted over it. The paint turned out different shades of yellow. He agreed to re-do the work, but he wants me to complete the rest of the payment. I first gave him a $1,000, but now he wants the second payment before fixing anything. He called me at 9 last night, asking for the money, which has now been all that he’s been focusing on lately. I’ll be happy to write the check once the work is properly done, but not at this point.

Response from RBS ASSOCIATES
This letter is in response to the member's complaint on July, 13, 2011. In 22 years as a general contractor, I have never been confronted with a situation like this one. The following is an explanation of chronological events that transpired between the member and RBS Associates. She hired RBS Associates in 2004 to renovate the majority of her house. The first stage of renovation consisted of converting the unfinished basement into a family entertainment room with a wet bar and full bath. The second stage consisted of raising the roof and constructing one bedroom, walk-in closet, full bath and a loft area. The third stage consisted of renovating the living and dining rooms. Finally, stage four consisted of vinyl siding the house and installing a stone front façade. The entire project was completed somewhere between the winter of 2005 to the spring of 2006. When we finished the project all inspections were finalized. This included electrical, plumbing, and building inspections. I did a walk through with her explaining the mechanics of the project. This included explaining the operation of the ductless air conditioning units with remote controls. Five years later when I received a telephone call from her that her basement flooded in the spring of 2010. I provided an estimate which she accepted and stated that I could do it at my leisure. I mentioned to her that I was very busy but would start towards fall or winter. She stated she didn’t care. At this point she did mention that she was having some problems with the air conditioning units. I told her that I would look at them when I came to the house. I stopped over to check out the air conditioning units and I determined that there might be bad batteries in the remote controls. She did not have new batteries on hand so I told her to get new batteries, test the units and get back to me. I never heard from her until February 28th, 2011, when I picked up a deposit check of $1000 to start the job. One of the agreements that she and I had was that she would shovel the path from the garage to the rear basement door. I arrived March 1, 2011 when there was approximately 18 inches of snow on the ground to an unshoveled path. After clearing the path (approximately 45 minutes) I began my work in the basement. During the work, she discussed with me she wanted to install a tile floor and tile baseboard (instead of colonial wood baseboard). I finished the job up to priming the walls. I figured I would wait until the tile came in to finish the painting (while two men were laying the tile floor, another man could be painting the walls). After initial contact with her, approximately a month passed without hearing from her after several attempts to reach her. I finally received a call from her. On April 29th, 2011, (the following week) I showed up to finish the painting. The beginning of June 2011, she mentioned that she had the batteries for the AC remote controls. I showed up and tested both air conditioning units. Both units were working in conjunction with the condenser. When I finished the painting I did notice the plastered seams of the drywall were showing (the seams did not show up under the primed surfaces). I called to talk to her about the walls and to get her email address so that I could send her an invoice for the second payment. She did not respond to my telephone calls or text messages. Finally, after a number of calls, we spoke. She mentioned that she was very concerned about the walls. I did acknowledge the problem with the seams of the drywall and I would repair the problem. We then talked about the invoice. I expressed that she never paid the second third of the total amount, which was approximately $1000. She then agreed to send me what she felt was a fair amount. At this time, she was suppose to text or email me her email address so that I could send her the updated invoice. I never received the information. She was then very adamant about both of us looking at the job. As we were leaving in three days for vacation, I told her I would stop by at night to look at the job. She stated that night time would not show the true light of the drywall seams. She was going on vacation the following week after I returned from my vacation. I wanted to come in and repair the walls. She denied my request. She was not accommodating whatsoever. We finally agreed to meet on July 20, 2011 (which was a month away). Before terminating our conversation she brought up the issue of the air conditioning units. I stated that I tested both units and they were fully operational. She disagreed with me. When I returned home from vacation on July 4, 2011 there was a check for $1000.00. A few days later after depositing the check I received a call from her saying not to cash the check. She then put a stop payment on the check. A week passed by and I received a text message from her talking about the situation with Angie’s List. In summary, I have done everything in my power to communicate with her in order to rectify the situation. She has made it impossible for me to complete the job and get paid. In regard to the air conditioning units, after five years of the original job being completed, I never heard from her until now that there was a problem with the units. That is plus or minus three years after the HVAC warranty (2 years parts/labor had expired). Up until now I was willing to help her by checking out the units. I am confident that Angie’s List can open up a channel of communication between the member and me. If she is still uncooperative I will have to no other choice but to seek legal action. Rick is great and we really like him. He is honest and you can count on him. He can get busy but he always comes through. He is a great guy to work with and I would highly recommend him. His prices are really good. If there is a problem, he comes back and fixes it. I would give him an A across the board, he is excellent all around.
Description of Work: RBS Associates has done a number of things for me in the past. The last thing he did was a bathroom remodel.

Rick brought new life to a really depressing kitchen and foyer. It needed everything, including releveling the floor and ceiling. Anyone who saw the "before" of this room is absolutely amazed with the transformation! He's honest, professional, courteous, knowledgeable, and patient. We had a positive experience w/ all of the people who work with him, as well: electrician, plumber, hvac, etc al. They did a great job, always cleaned up at the end of the day, and came up with ways that we could actually use the kitchen throughout the project. We will definitely hire Rick again, and have already recommended him to friends and family.
