"UNTRUE STATEMENTS!. Dear customers, All of these comments were proved untrue in small claims court, I have court documentation with proof. I filed a small claim in court to recover upaid costs from this customer, he appealed the claim, he did not sue me, he was not awarded anything. I can email anyone the court papers upon request. Angies List does not allow false comments to be removed from the site. This customers comments were posted on Angies List 2 weeks after the court decision, making them illegal slander. We completed a project for $2,500 for this customer. I reviewed the specifics with the customer onsite. 36 yards of loam on certain areas. Once we finished the job he refused to pay, and demanded that we excavate, grade, and loam and seed another 100x100 area of his back yard (estimated $15,000 cost). His defense in court was that he did not know anything about construction, how to gauge amount of material used, or contracts, and was tricked into this thinking he was getting his entire back yard excavated, graded, loam and seed. However, the judge asked him what he did for a living, while shaking he responded, I am a retired Construction Manager and Company Controller, responsible for reviewing all costs associated with construction, Prior to this job he was a Company Controller for a Material Trucking Company. ( he previously said to the judge that he did not know how much loam 1 truck held and that he did not believe we delivered 36 yards. Also, I provided a receipt with his address and delivery date from a professional supplier and delivery company. This customer was very educated in construction, contracts, and trucking / material and spent a lifetime in top management at these companies. He had a new landscape company complete various projects around his property, including stone work, fence work, front lawn renovation that was not included in our contract, and back yard excavating and grading, and hydro seeded the entire property. In his appeal to my claim, he attempted to sue me for all of the costs for these projects saying I was responsible, however after we broke down what projects were complete by the new landscaper he was dis credited again. He also admitted to the judge that the loam that I delivered and spread was not removed at an additional cost from the property, as a result of glass being in it, as he originally claimed in his appeal. I offered to reduce his contract price by $500 several times and he refused, I offered to return to the job and review his questions in detail, with another expert, and with his attorney, but he refused. He did not pursue any claims against me until I filed a claim in court, for the amount he owed me. I filed in September 2013, the job was complete in May 2013, 4 months earlier. We have since updated our contracts to require specific areas that we will complete work in, with estimated amounts of loam for each area, with customer approval for each area. There are some people out there that are not honest this was one of them. Thank you, and again I can provide court documents showing proof that his comments are untrue. I contacted three service providers one of whom responded with a visit and never came back with a quote. Another did not respond at all, and Dan Cahill of Cahill Landscaping who contacted me within two days of my call and came the next day to survey the job. He responded the following day with a quote and we scheduled the job. His team was on site for portions of three days and accomplished exactly what we wanted. They were professional and personable and incorporated our suggestions to ensure that everything was done to our satisfaction.

-Scheduling: We made a deposit payment of $1250 back on Jan. 31st and we were assured that we would be the first on the list once the weather and temperature cooperates. The end of March arrived and the weather was good - all the snow has melted but I still did not hear from Dan. I called him twice to follow up. Each time, he said he would come 'next week' - but no show each time. I was about to fire him and wanted to get my deposit money back, but then he said he would come the very next day, which he did.
-Pricing: Dan grossly under-estimated the amount of loam needed to complete the job properly, so I ended up paying $650 more than the contracted price for an additional truck load. Not happy with this at all. Also, he sent one of the workers to collect this payment immediately hours before the job was done just to be sure that I will pay for this extra charge. What was disconcerting was that one of his employees knew on the spot that there wasn't going to be enough material and more had to be ordered even the job began.
-Quality of work: Overall, the crew did a good job.
-Professionalism: An argument broke out between Dan and one of the workers over the amount of loam ordered. They were screaming and throwing F bombs right in front of the customer. Awkward and not very professional.
-Follow-up: Even thought the majority of the lot was nicely done, there were a couple of large puddle areas where water was collecting and won't drain so we called Dan to come back to take a look. We do realize that it just might be a draining issue with that particular area and might not be something that Dan can do to fix. However, on the phone Dan was very defensive and right away said that the contract wasn't to "making the lot flat" . All we wanted to do was for him to come back to take a look, but he was very reluctant to make the follow up.
"Thanks for the feedback, your lawn came in perfectly green, I am sure you are happy. We did not under estimate the loam, you requested more loam for a different area and we satisfied that request. We were not able to get there in March, because the weather was cold and rainy and loam and seed would wash away, you were the first customer this year. Regarding any argument between employees, we apologize things can get hectic in the spring and very busy, and demand the best from eachother so that you get the quality work that you have now. We did not return to look at the puddles because you accused us of mis grading, when the job was clearly to add 3 inches of loam, there would be no grading. The issue was the raised garden, the patio, and a hill creating a pool where water would gather. I recommended a retaining wall and draining system and you did not agree."

We confirmed that my crew walked the entire property with you and your husband after the project and you and your husband loved the quality of the work and were very thankful for the job we did. I also received a written note from you thanking us for the excellent job. We also received compliments from a friend of yours that said you were very pleased. Regarding the timing of the work, I walked the entire project with you and your husband, we went over the details, and signed a contract and I gave a rough estimate of when the work would be complete. I took extra notes on the project because we confirmed that you and your husband would be at home and would not be there to discuss any details during the project. We completed the work within one week and I did not hear any concerns until over a month later after we sent a second invoice. My records show that we were at the property for over 12 hours on the day of the project. I returned and looked at the property and I did not see any signs of thin mulch and I did not get a response from you regarding the second walkthrough. Please read my exact email to you below, this was in response to your concerns and I did not receive any follow up from you. I thought these concerns were addressed; it has been almost one year since we completed the project. We would be happy to talk to you and provide a discount on your next project. Also I will look over the work to address your concerns regarding the mulch. They spread 2 truck loads which usually amounts to 10-12 yards, if there are thin spots we will take care of it. Also I thought we took care of everything in the backyard, if you can let me know what the specifics are I will look over the proposal and take care of anything we may have missed.
