UNTRUE STATEMENTS!. Dear customers, All of these comments were proved untrue in small claims court, I have court documentation with proof. I filed a small claim in court to recover upaid costs from this customer, he appealed the claim, he did not sue me, he was not awarded anything. I can email anyone the court papers upon request. Angies List does not allow false comments to be removed from the site. This customers comments were posted on Angies List 2 weeks after the court decision, making them illegal slander. We completed a project for $2,500 for this customer. I reviewed the specifics with the customer onsite. 36 yards of loam on certain areas. Once we finished the job he refused to pay, and demanded that we excavate, grade, and loam and seed another 100x100 area of his back yard (estimated $15,000 cost). His defense in court was that he did not know anything about construction, how to gauge amount of material used, or contracts, and was tricked into this thinking he was getting his entire back yard excavated, graded, loam and seed. However, the judge asked him what he did for a living, while shaking he responded, I am a retired Construction Manager and Company Controller, responsible for reviewing all costs associated with construction, Prior to this job he was a Company Controller for a Material Trucking Company. ( he previously said to the judge that he did not know how much loam 1 truck held and that he did not believe we delivered 36 yards. Also, I provided a receipt with his address and delivery date from a professional supplier and delivery company. This customer was very educated in construction, contracts, and trucking / material and spent a lifetime in top management at these companies. He had a new landscape company complete various projects around his property, including stone work, fence work, front lawn renovation that was not included in our contract, and back yard excavating and grading, and hydro seeded the entire property. In his appeal to my claim, he attempted to sue me for all of the costs for these projects saying I was responsible, however after we broke down what projects were complete by the new landscaper he was dis credited again. He also admitted to the judge that the loam that I delivered and spread was not removed at an additional cost from the property, as a result of glass being in it, as he originally claimed in his appeal. I offered to reduce his contract price by $500 several times and he refused, I offered to return to the job and review his questions in detail, with another expert, and with his attorney, but he refused. He did not pursue any claims against me until I filed a claim in court, for the amount he owed me. I filed in September 2013, the job was complete in May 2013, 4 months earlier. We have since updated our contracts to require specific areas that we will complete work in, with estimated amounts of loam for each area, with customer approval for each area. There are some people out there that are not honest this was one of them. Thank you, and again I can provide court documents showing proof that his comments are untrue.
