The facts of the case are as follows. I contacted William Flannery on a Craig?s list advert for AC repair of an outdoor central AC unit. He expediently came to assess the outdoor AC unit and assessed it as beyond repair and needing replacement. He instructed me that he could install a 13 Seer AC unit, which was the ?highest SEER rating they offered?. He further went on to add that it ?would qualify for the government rebate? to further entice the sale. As a secondary issue, he discovered an old air handler filter that needed replacing and we agreed to have it changed as well. We agreed on a total package price of $1600 for the above. I told him I would be at work, but he could come in to install the items. I thus left the door to my house open and the check on my kitchen countertop. That night I looked online and found that 13 Seer was not the highest Seer rating and further that it did not even meet the government approval rating for the rebate. I called him that evening. Mr. Flannery assured me that the AC unit was of sufficient rating to qualify and told me ?Don?t worry, I?ll leave the paperwork to that affect? on the countertop. When I got home the next day, a new AC unit was installed, the old AC unit was not removed, the filter was not replaced. Moreover, the new AC unit was a 13-SEER unit which, as I feared would not qualify for the rebate to which was alluded and their was no paperwork indicating that it should as he had promised. He left a manual for the AC unit and a receipt indicating $1600 for ?Remove old AC unit 2 ? ton?, ?Janitrol Condensing Unit?, ?New filter?, ?5 years & labor?. He identified my payment as ?ck#494?. I called Mr. Flannery immediately regarding the above. He claimed that he never stated a claim that my AC unit would qualify for the government rebate. He also stated that he left the manual and that was the paperwork he was talking about. He stated that the day prior he was merely was talking about the government rebates, and denied stating that my AC unit would qualify. (All of which were lies.) He said he would come to get the old AC unit because ?[he] got paid for it? and he would replace the filter as stated on the receipt. He took the dimensions of the filter and told me he would get his man to do it. After this point, 55 days, 7-10 phone calls, and many, many excuses have transpired. To this day, nothing was ever done about the falsified claim of elevated SEER rating and lost funding for the alluded to government rebate. In addition, noone ever came to my house to finish his promised and paid for work. The old AC unit is still sitting at my house (I will pay myself to have it removed this week) and I have just replaced the air handler filter myself. To me, Mr. Flannery, the President of Cox?s Old Colony Plumbing & Heating has delivered an AC unit not fitting the description promised and reneged on the 2nd and 3rd items in the agreement. The most recent claims were that he would come to finish the job on Monday September the 13th. That morning I called to see when he would arrive and he accused me to his colleagues of being a ?stalker? who wouldn?t leave him alone. I told him I was looking at the Better Business Bureau webpage and he threatened that if I filed a claim he would come to ?my office? and tell people I was ?unstable? and ?ruin my work?. He then said he would have someone come to remove the AC unit ?today? (9/13) but that he wasn?t ?driving all the way out to replace a filter?. I informed him that if it was not done today I was filing a complaint with the better business bureau. This was yesterday. I replaced the filter yesterday myself. Noone came to remove the AC unit as promised. And I am left to question this man?s honesty, integrity, and business practices.
