Surprisingly well considering my house is about 50 yrs old..they took everything in stride when my things came up that they were not expecting.. like floor joists that didn't meet up when they tore down the wall. but they fixed them. I had used them before to build a sun room and i will use them again to do a make over of my bathroom and laundry room.
Description of Work: Gutted existing kitchen. tore down wall between kitchen and hall to enlarge kitchen repaired ceiling and floor. Installed recessed lighting in ceiling. Installed 7 new electric outlets.laid linoleum. Installed new cabinets, sink and dish washer. Painted ceiling and walls. Installed ceramic tile back splash..

Sept 26th: A contract was written, agreed and sign by both parties. Week 1. Sept 28th, R&S Construction started work without a Building Permit and without having our Fire Mashall Review Letter handy. (inside is our stamped and approval of our building layout that our architect design). R&S seems unprepared and incapable of starting the job properly. Week 2. Oct 3, Minor adjustment was made to the frame work. R&S charge us an extra $800 for minor changes. Oct 5th, We got an email stating R&S is unable to pull a building permit due to liability of other subcontractors. Unless, we meet their conditions for extra payments of taxes and insurance, and the cost of using their electrician. A bill of $6000 more. Thus exceeded our budget agreement. Oct 6th, I made a phone call to his business partner (Who is more informed). He explained why they are not able to pull the business permit due to liability. In reply, I do understand this situation, but a contract was written, agreed, and sign by both parties. Shortly after hanging up, the owner of R&S called and was angry. He was ready to terminate the contract and threaten to send us another invoice for default. Oct. 12th, After a couple of emails of trying to get together to discuss the matter, we finally met up in week 3 to discuss out options. Option 1. Continue work based on R&S change order of $6000 more. Option 2. Terminate Contract. We couldn't afford the new price and conditions so we both agreed to terminate. Oct 14th, Two days later we received another invoice of almost $9000. Where did this $9000 come from? Supervision fees (really!@?), dumpsters, (there was a community dumpster they could of use) ETF... R&S was paid more than enough for the first week, and now they are attempting to get more money from us. We are currently seeking legal help. This should never be a situation for anyone. If R&S was confident in their work, this argument over obtaining a building permit should never happen. If so, it should be address at the time of Contract, and never in the middle of work week. This delayed our project and other subcontractors to finish their job.
Description of Work: FRAMING, SHEETROCKING, CUSTOM COUNTER AND BENCHES REPORT DATE: OCT. 16TH, 2011 WAS WORK DONE: NO Contractors stop in middle of work week b/c they couldn't agree to get a building permit, unless additional payment was made. HIRE AGAIN: NO COST: $18,000 PAID: $4,500 DESCRIPTION OF WORK: Contractors are to frame, sheetrock, and build a custom counter, bench, and wall for our yogurt machines. COMMENTS: R&S Construction started work without a building permit, is High Price, Unprofessional, and Greedy. Instead of helping to resolve this issue, they want to terminate our contract and bill us another $9000.00 For Consulting Fees, etc.

Response from R & S Construction Management SVC LLC
In accordance with the contract documents, R & S was hired as a subcontractor to the owner. The contract specifically called for the owner to pull all permits as agreed. When the owner failed to secure these permits, R & S pulled off of the project due to the delay. R & S met with the owner to resolve this issue. R & S was informed that the owner had another contractor that was several thousand dollars cheaper that could do the work. In order for R & S to secure the permits, R & S would have to absorb all of the contracts (subcontracts currently held by the owner) and charge the owner a reasonable fee to cover the additional liability associated. The owner at that time could not afford to have R & S complete this project. The owner informed R & S that they never priced this project prior to awarding the project to a contractor therefore they did not have enough money to complete this project. R & S agreed to terminate the contract and offer "FREE" Construction Management Services to the owner to see the project through completion. The customer declined. The customer attempted to terminate the contract. The contract stipulates that if the owner terminates without cause, R & S is entitled to its anticipated profit. R & S attempted to exercise this by submitting a final invoice for the labor and materials delivered to the site. R & S had delivered all of the building materials and a dumpster to this project. Construction debris cannot be deposited into a building tenants dumpster. R & S provided additional labor (not included in the contract) to the customer to help clean up the job from all of the debris left behind after the demolition of the existing space. This was suppose to be cleaned prior to R & S arriving on the project. Once R & S was able to begin its work, the customer notified R & S that the drawing's he originally provided and part of the contract documents,were not correct. R & S was asked to coordinate with the architect to secure a new set of drawings. By the time the owner informed the site, all of the interior walls had been installed. According to the new drawings some of these walls needed to be moved. Additionally, the customer did not like the layout of his service area as drawn by the architect. R & S accommodated the customer and designed the new service area to meet the customer's needs. A price for making these changes was agreed to with the owner before the work began in accordance with the contract. Signatures were made by the customer to the red-line drawings accepting the changes and R & S went to work. Once the changes were completed, R & S inquired to the status of the permit. At that time the owner the customer, informed R & S he was unable to secure this and requested that R & S secure the permit. Due to the conditions of the contract and that R & S was not acting as the general contractor and the owner was, R & S declined the additional liability associated with the permit. R & S submitted a final bill in accordance with the contract for all labor and materials along with lost anticipated profit. This invoice was never paid. All materials were left on this project. R & S never perused the outstanding balance.
