Terrible work, unprofessional, unreliable. 4/22/19 Owner Wayne V. received $3000 down payment. Work was delayed by an unusually rainy May which was understandable. June and most of July consisted of promises to begin work and excuses when it didn't happen. 12 weeks after paying him $3000 on 7/15/19 approx. 1/3 of the driveway was "installed" poorly with hand tools leaving a lumpy uneven mess. The crew worked until 10pm, ran out of material and departed indicating they would return the next day. 7/16/19 Nothing. 7/17/19 One worker showed up then left. Later that evening Wayne said his truck was full of asphalt broken down nearby and begged $200 to fix it. After another week or so of getting the runaround had to fire him and hire another company to finish the job.
Description of Work: Driveway repave.

Superior Asphalt New Castle IN. (Wayne Voiles) On July 11, 2017 I signed a contract with Wayne Voiles (Superior Asphalt) to expand, crack fill and seal my large driveway. The total amount was $6,000.00 of which Wayne required half down ($3,000.00). I wrote the check (as requested) to Wayne Voiles not Superior Asphalt. Upon receiving the check Mr Voiles said he most likely would begin our job the following Monday (July 17). Monday came and gone as did the next whole week...no sign of Wayne or his crew. I called, left a voice mail and eventually Wayne responded by telling me we were NEXT in line. Another three days passed and I called again he answered and said he was ”on his way”. He never showed up but had several excuses as to why he was absent. For weeks, I consistently tried to call him but always got his voice mail and no return call from him or if he did return my call, it was always a promise he never kept. By this time, it was mid-August and I was beginning to understand he was never going to complete our work and contacted our attorney. Was advised to contact Mr. Voiles one more time and explain he would face a lawsuit if he did not return to the job and complete it as contracted. I called again (left voice mail message) and explained I had spoken to our attorney and we needed him to do the work or we would file a lawsuit against him. I received a return call saying he was within minutes of our location with a partial load of asphalt. He arrived within one hour after our conversation with a “hot box” approximately half full of left over asphalt from a previous job. He and his crew worked 3 hours, until about 9:00pm unloading, spreading and compacting the asphalt. This amounted to approximately 20% of the quoted asphalt for the completed job. He never returned to bring more asphalt or complete the job. Approx 5 days after he was last on the job, two of his “crew” came to me with a request that they be allowed to finish the job on their own and that Wayne was going through a divorce, was an emotional wreck and had not paid them for the last two jobs they had worked for him. They had no idea what Wayne had done with the $3,000 he was paid in advance but they needed money and was willing to work to complete the job on their own. They said Wayne would let them use his equipment to do the work but I would need to purchase the additional asphalt required. I reluctantly agreed and the next day we purchased hot asphalt but when it arrived we were told that Wayne would NOT let them use his equipment and the asphalt was poured but not properly compacted. In the days following, it was obvious that Wayne was the skilled person and the crew were just laborers and had very little knowledge as to how to finish the job. I paid for the asphalt, the trucking, a rented roller as well as an additional $ 475 to the “crew” for their labor and called another “professional” crew to complete our job, losing my original down payment all together. In summary, Mr. Voiles collected $ 3,000 for work he had no intention of completing. He has avoided numerous phone calls to try to “work this out”. He says he didn’t get my messages on numerous occasions although I have phone records showing my calls to him. I am currently waiting, as I have 24 months to file suit against him to see IF he will try to make this right. Although I understand he may be emotionally distraught, he has no right to keep our money for work he did not perform.

This guy pulled in my driveway one day and I asked who he was and what he was doing. He had a company truck and told me he was doing a job in this area and he told me he could give me a good price if he could do it today. I agreed to have the sealer done and he verbally told me that the sealer would take care of the cracks in the driveway and if I had any problem with it to give him a call. The next day I saw the cracks were still there and I made the first call to him on 3/28 and again on 3/29. He answered the phone on 3/30 he said at that time that he didn't know what day but that he would be here the next week and that he would call me. On 4/4 I had not heard from him and left another message. I talked to him on 4/6 and he told me he would be here on 4/9. He didn't come and I never heard from him. I left another message and received no respose. I called on 4/10 and he gave me his word that he would be here that day and I have never heard from him.
Description of Work: He sealed my driveway.

Response from Superior Asphalt of New Castle LLC
I have done asphalt work for the past 18 years. When you tell someone you can clean or blow the driveway off repair the cracks and sealcoat the driveway that doesn't mean you are giving them a brand new drive. All the cracks and improfections will still show. The perpose for sealer is to waterproof the asphalt and keep the cracks from growing. That doesn't mean the customer is getting new asphalt. I can repair the large cracks but I can't make them invisible. When someone has a problem after I have done work I always make it back out to look at the job but I can't replace the driveway without compensation or hide the improfections in the old drive I am very good in my field but I can only do so much.
