Electricians contracted by David Kovich at Komark LTD came to our house after I reported serious electrical concerns with outdoor lighting as well as ceiling lights in family room and kitchen flickering on and off. One electrician quickly assessed that the ceiling lights had faulty thermostats and would need to be replaced. The second electrician working on wall switch reported that wiring was faulty and needed to be corrected in which he did. After electricians corrected the problems, David Kovich became irritated when I pointed out another flaw with his electrical system during construction of home. Kovich became angry and started yelling at me in the kitchen of my home as I continued to point out other concerns with counters. Kovich began cursing at me as I attempted to calmy express my concerns with the quality of craftsmanship and products used during the building of my home. It is clear that David Kovich does not value his customers. When feedback is provided concerning flaws in building process, David becomes deflective, irresponsible, negligent, untruthful and extremely disrespectful. I strongly discourage anybody to build or remodel their home with David Kovich of Komark LTD. We spoke with the county at the end of February and confirmed that David switched the plans for the driveway and it was not this dangerous or steep when submitted to the county. The county is holding David Kovich of Komark homes responsible for fixing this hazard.

Initially when we spoke with David he told us he could build us a ranch home for $260,000 to $270,000 with a loft and a partial unfinished basement. It sounded like he was having difficulty with the original piece of land and building a basement on that property. Although he never told us for sure. He introduced another piece of property and told us with an unfinished basement it would be $284,000 no loft. We decided to go ahead with building the home. At a meeting when we signed the purchase agreement he told us the house would be $286,271. David gave us an allowance for landscaping, counters, cabinets, tile, lighting and other flooring. We had to work with vendors on our own. The vendors were confused and did not really know our budget or allowance. We had a $6,000 allowance for counters and more than half way into ordering granite he told us he made a mistake and the allowance was $5600. We had to constantly email him to remind him of his mistake and how we should not be penalized for the $400. There were issues with all the vendors mostly because of the miscommunication with David and his vendors. He mentioned closing would be November 15, 2014 or before. This was on the purchase agreement. After several emails and texts asking if this was still the close date (mortgage broker also needed to know) he mentioned we would be closing on November 17. He knew we were working with a relocation company and needed to schedule our move ahead of time. During and before all of this confusion we wanted to know where we were in our budget. although we thought we were within the budget and knew we went over with tile, he said he did not know for sure because he did not have all the invoices. I had received invoices from vendors but he said he would have to sit down and look at everything and let us know. He mentioned he would have this in a week. A week later no response. I called and his wife answered and was very rude. She said "Yeah we don't know yet." Finally a week after this we received the paperwork and it was incorrect. I pointed out the errors and he corrected. We hired an inspector to inspect the home. The inspector arrived two times and both times he said the house was not ready to be inspected because there was too much unfinished. This was a couple days before closing at this point. The radon test showed 12 which is high. After letting David know the results he said he does not believe in radon testing and would not pay for a system. Being a new house this is easily preventable in the building process. They consider themselves Green Builders so this was very confusing to us. Finally he verbally told us if we purchase a testing system and test over one year he would pay half the cost for a radon mediation system if it still showed up high. We would have cancelled this purchase but we already gave him $10,000 toward the house non refundable. Closing was not the 17th. David moved it again to the 19th. Our lock with the mortgage company expired so we had to get an extension. On the day of closing on November 19, our seed and sod was not on the property. The title company told him he would have to keep his money in escrow until it was laid down. He had until April 30, 2015. This house was being built from March through November. This could have been done in the summer or early fall. His money was held in escrow. After about a week of our move in, David and his son laid down sod and seed. It does not appear they used topsoil and the type of grass is different from other grass in the neighborhood. It is bumpy and unflattering. we called the title company and told them it was unsatisfactory, but David already received his money back. We keep asking how much we have left in the landscaping budget after sod and seed and he does not respond. We closed on the house and moved in. The house was dirty. There was no heat vent in the hall bathroom. The toilet paper holder fell off and the light switch to the back deck was not working properly. The cabinets were scratched, the wrong handles were on the cabinet doors, the granite was chipped and pitted, there was water in the basement, the sidewalks and driveway were dirty, there was no glass in the shower in the master bath, and there was no mailbox. Also, there was a big burned up old tree stump on the land next to us an inch away from our property. I witnessed David's son Patrick lighting this on fire the day our inspector arrived. We asked when we would be getting shower glass and he put us off for a week and finally told us when they would arrive. He told us he would give us a shower rod to use and would want it back afterwards. When he schedules appointments they are always a day ahead of time and just assumes we would be here. I called David about the basement water. He told me it was condensation coming from the HVAC unit and the pvc pipe just needs to have an elbow to make sure it is going into the hole in the ground. After researching this myself, I noticed it was coming from the water heater. I mentioned this to David and he looked at it and agreed. He called the plumber out and the plumber said he forgot to finish the job. David would come over unannounced wanting to fix things on his time schedule. He finally fixed the vent but now it is so tight in the floor we can never remove it. He had another contractor fix the toilet paper holder. I asked when we will be getting the mailbox and he gave me a person's name to call. He said it was not included in the house. I mentioned that was unacceptable and finally agreed to cover the cost. The box came a week later. The electricians did not feed through cable wire to the outside. Our internet and TV could not be hooked up. Finally he scheduled electricians to come back and finish the job. We could not hook up our dryer. the electricians installed a range outlet. David said this was the new dryer plug and was to code and if I bought a pigtail for the range outlet he would install. After researching this I found out he was incorrect. I called another electrician and they said that he was incorrect and could actually be a fire hazard. So I called avid and told him I was having an electrician install the correct outlet. I paid am electrician to install a dryer outlet. We finally resolved the cabinet issues after a couple of weeks. we are still in dispute with the landscaping budget and unsatisfactory work and the counters. Weatherstripping came off the front door and he has not responded to us. The driveway is a safety hazard. It needs to be graded so cars can drive up. Most cars bottom out and we have been asking for how much of a slope it is and he is not responding. He rarely answers our emails or texts. In response to Komark Homes on January 29: His statements are false. Initially, he told us the home would be $284,000 with an unfinished partial basement. This was not the case. The driveway is unsafe and was not the way it was submitted on the building permit per Tippecanoe County Commissioner's office. A representative came out and measured the driveway, which was a 30% slope. The slope can be no more than 15% or it has to be on the permit and it was not. Working with the county to get this resolved since David is not fixing the problem. The dryer outlet is a range outlet and is not to code. We changed it correctly by a licensed electrician so there would be no risk of a fire. It is unacceptable that a builder would not fix a major radon issue while building the home. This is unsafe and a health hazzard.

Response from KOMARK LTD
Komark, Ltd. met with [member name removed] about building a new house from the middle of January 2014 till the later part of March 2014. Their price point Indicated that they could probably afford an 1800 to 1900 sq. ft. home, once they sold their existing home. Komark, Ltd. suggested an 1840 sq. ft. home with an unfinished basement, or a crawl space home with an additional room above the garage. However, the negotiations ended without the parties reaching an agreement. Subsequently, a spec home was begun with 1840 sq. ft. on the first floor and 700 plus sq. ft. finished basement. The [member name removed] returned and signed a purchase agreement for the spec home with an anticipated close date, per the contract, of November 15th, 2014. The actual close of sale occurred on November 19th, 2014. [member name removed] did not want the basement finished, so a credit was applied thereby resulting in a final price of $286,271.00 at closing. Due to 7 days of rain in October, 9 days in September, and 15 days of rain in August some outside work was completed after closing, and the landscaping is to be finished in the spring of 2015. Obviously the letter submitted by [member name removed] does not square with the facts. In the interest of brevity I am providing the following short responses as they apply to their numbered paragraphs. 1. The Inspector’s report by inspector, hired by [member name removed], found a few minor items and they were promptly remedied. 2. We received a Certificate of Occupancy and a Thermo Scan report that put the house in the mid 50’s form the blow door and duck test (approximate 1 % air leakage). This plus our recycling program are the essence of a Green Home. 3. “Radon” We do not Include it, but it may be added as an upgrade. 4. “Allowances” To date [member name removed] have received back over $3,000.00. Subtracting it from the contract price of the house ($286,271.00 - $3,000 = $283,271.00). Most people would be excited about that. 5. “House being build March to November.” Did not received the Building Permit until May 21, 2014. 6. “Sod layed or partial frozen ground” It is now protected against erosion violations. [member name removed] were informed it may need rolling in the spring. 7. “No heat vent in hall bathroom”. Register cover was missing. It has been installed. 8. “Changing dryer pitgtall” [member name removed] electrician installed the new 3 prong box for the dryer without giving Komark Ltd. the opportunity to do it at no cost. Now they want Komark to reimburse them. Komark Ltd. was aware of the new four prong requirement as the county only recently changed the standard. Komark was informed by the Tippecanoe County Bldg. and Code Office that the change would be approved by changing the three prong pigtall to a three prong pigtail that fir the 4 prong box on the wall. Komark, LTD was in the process of doing so when [member name removed] said they would have it done. Thus [member name removed] incurred an unnecessary expense of $137.00. 9. “Driveway is a safety hazard.” There are a number of driveway that are steep because of the topography of the lot. A side-loaded garage was installed to alleviate the elevation difference and to enable the homeowner to avoid backing up. Secondly, we lowered the garage floor to help with the driveway incline. The county would not approve a safety hazard. We have been building homes for 35 years. We are proud of the homes we build and our reputation. Is every home perfect? Of course not. But when a call back is required we answer it. All we ask is that the buyers be reasonable. Unfortunately, that is not always the case.
