A good-faith deposit was given to Kaercher's Contracting and upon termination of the project, Justin has failed to refund the money. I entered into an agreement with Justin Kaercher around the 1st of July for a project that was to total 4K in expense to have a cedar fence installed, my back patio reshaped and the existing concrete on the patio and the front walkway of my house redecked. I recieved an estimate that used the BBB logo despite not being a member, and holding an F rating. It wasn't until later, I realized that he was not accredited by the BBB. Justin requested 2K up front for the project. I didn't feel comfortable releasing this much up front so we instead agreed that I would pay $500 every couple weeks as the project progressed. Over the next month+ the only thing that got completed was the demolition of about 40 feet of concrete... not a single part of the main aspect of the project was completed. Each time I made a payment, I wouldn't see Justin for at least a week or two, and then he'd show up and do just enough to ask for more money. The second check I gave him, he sent me text messages requesting that I meet him to give him cash instead or meet him to take it to the bank to cash the check for him... at this point I become very uncomfortable with the entire project. The fence portion of the project was to be 2K of the total 4K estimate. Since I had given him 1K in a deposit, he had 1/2 of the deposit for the fencing project ... so I asked him to forget the rest of the project and just to install my fence for me. He didn't have the money to buy the materials, despite having cashed $1000 of my deposit. He instead stated to tell me that he'd have to charge me more for breaking up the concrete. I then cancelled the project and asked for a refund. In writing, on my estimate, before the scope of the project expanded - he had priced the concrete demolition out at under $200. However, once I cancelled, he came up with over $500 in charges for the project. We discussed via e-mail and settled on that he would refund $700 of the deposit. However, even if his expenses did come out to $500 for demo on the concrete, the remaining $500 of my deposit has since been used and I've been told more than once by Justin that he does not have the funds to return my money. The original request to refund my money was made on August 21st. We reached agreement on the amount of the refund on September 21st. I have since been told that he was going to bring me a check on September 23rd, 25th, 28th and the 1st. After missing the most recent date he gave me of the 1st - he has not responded to my e-mails asking when I will recieve payment. At this point I plan to turn over the estimates I have with him using your logo fraudulently along with contacting the EVPD and have been in contact with the Building Commissioner regarding the next steps to take for formally filing complaints and holding a hearing regarding his contractor's license.
Description of Work: Justin Kaercher was hired to remove my existing fencing and install 6' cedar fencing with 2 new gates. In addition, he was to remove some concrete from the driveway, reshape my concrete patio in the back and perform a service called Redecking on my back patio and the front walkway. The total cost for the job was to be $4000, which included both materials and labor.
