Cedar Siding has advised they will do nothing that Mr. Joe Robinson openly promised, which I considered a verbal contract. Mr. Robinson openly stated that his compnay stands behind their product and at the very least they would have the siding repainted to match the current faded color. Mr. Robinson stated that I would not require an attorney to see this issue completed, his boss was a fair man. Mr. Robinson stated after our first meeting that the next day he was playing golf with the owner of Cedar Siding and that he would discuss the issue of our siding, but it appears that Mr. Robinson was not very successful or was wrong about the owner of the companysent an e-mail to Cedar Siding asking the name of the paint manufacture to inquire of their warranty concerning paint fading and peeling. Cedar Siding replied with an e-mail advising me that it would have a sales rep contact me with the paint manucfactures name and warrnty info...they never replied to my request. Mr. Robinson as a leagl representaive of Cedar Siding stated his company would make good on the repair of the siding (James Hardi Siding is repairing the defective siding) but as stated by Mr. Robinson Cedar Siding has not shown good faith, not honored their verbal contract and done absolutely NOTHING to correct the faded or peeling paint. As stated, Mr. Robinson stated Cedar Siding would re-paint the siding since the paint on the exterior siding has peeled, cracked and faded. James Hardi Building Products stated that the paint applied by Cedar Siding was the cause of the siding cracking and peeling. Cedar Siding passes the buck and blames it on the paint company and takes no responsibility for its workmanship.
Description of Work: Our new home was constructed in 2005 using James Hardi/ Hardi Plank Siding on approximetly 3500 square feet of exterior wall space. In early 2009 we obsevered that many areas of the Hardi Plank siding was cracking and the exterior paint was peeling from the siding surface. I made a formal written complaint with James Hardi Building Products. On July 29, 2009, James Hardi sent Robert Schwartz/Field Inspector for James Hardi Building Products . to our home to observe and report. On September 4, 2009, Hardi Building Products adivised that our siding faliure was due to the paint being applied by a thrid party supplier (Cedar Siding) and that process caused our siding to crack and peel paint. James Hardi stated that Cedar Siding used inferior paint or applied the paint improperly. James Hardi stated they would use Best Practices and replace 400 square feet of primed siding, but would not paint the siding. I followed the paper trail and was advised that Cedar Siding, Rochelle, Illinois was the third partry contractror that painted the approximetly 3500 square feet of siding. I contacted Cedar Siding and spoke to Joe Robinson, who is the Illinois Regional Sales Manager for Cedar Siding. Mr. Robinson came to our home twice, once alone and once with a Mike Peters from Midwest Siding. I asked Mr.Robinson if I required the assistance of a leagl represenative to assist in getting our siding replaced and repaired. Mr.Robinson stated verbally that that would not be required, as he knew the owner of Cedar Siding and he would see to it personally that the defective siding would be replace and the entire siding would be painted, as the current siding color had faded. Also in the presence of Mr.Peters, Mr. Robinson made it a point to openly state that the color of our siding had prematurely faded and that he felt Cedar Siding or Midwest Siding (Mike Peters employer) should make good and as gesure of good faith and have our siding repainted. Since the new siding to be applied as primed only, Mr. Robinson stated that a smaple of the current siding could be taken to the lab and an exact color could be produced.
