26 September 2010 To whom it may concern, This letter is a formal complaint regarding real estate agent, Biljana Savic (476423949). In May 2010 we made an offer on a listing represented by her, specifically 2703 N. Francisco, Chicago IL 60647. The contract was signed, house had been inspected and earnest money delivered and cashed. The house was appraised at a value 55K lower than the asking price. We made an appeal to the appraisal company, but were ultimately unsuccessful. It was our intention to buy this house and so we didn?t begin the process to retrieve our earnest money. We continued to be in communication with the sellers, their agent, and their attorney. We regrouped and made a second offer with a price rider that would reflect the appraisal value. The sellers were now aggressively persistent in their desire to close and although we pushed for an early closing it was logistically impossible. This is the point at which her services became problematic. She phoned our mortgage broker incessantly, resulting in our lawyer requesting she not contact him. At the same time there were a bevy of problems with our own buyers agent and we were in the process of disengaging her. Thus, I phoned Biljana directly to inform her of the progress of the appraisal and request she no longer phone our mortgage broker. To this she replied with a string of expletives, told me ?I don?t know her job?, ?I can call him all I want?, accompanied with some personal attacks. I hung up on her and entreated our lawyer to intervene. The house again fell short of the asking price, including rider and the contract dissolved on July 30, 2010. This is where the problems become heinous. The seller?s attorney released the earnest money to us on August 5 and again on August 12, following with two separate release forms that were intended to exonerate Biljana and the Seller?s role in fraudulently changing the utilities. I made multiple requests of Biljana and the Coldwell Banker office to execute the forms necessary for Coldwell Banker to release the money. In short, the internal lawyer at Coldwell Banker communicated that Biljana was dragging her feet, thinking it appropriate to retain the money. As well, all follow up regarding any subsequent Biljana Savic?s treatment of our mortgage broker and myself was thoroughly unprofessional and prolonged possession of our earnest money fraudulent in trying to resolve the identity theft that she and her clients committed. Refusal to respond to phone calls and requests for a meeting to execute the proper forms was childish and certainly used up any collaborative spirit my husband and I had with her and her clients.
