I had a condo fire March 21, 2010. Doug Newby was hired by the restoration company to do my cabinetry and trim work in my condo. Doug showed me some brochures from Bertsch Manufacturing and said he could get me birch wood cabinetry for the cost of my allowance plus $1500 for upgrades. I picked out the finish and door style from sample he brought to my condo. I gave him a check for $1500.00 for the upgrades on June 18, 2010. He said he was going to order them the following Monday. Six weeks later on July 30, 2010 Doug notified me that the cabinets arrived damaged and would have to be re-ordered. I moved back into my condo on July 30, 2010 without a kitchen but anticipated the cabinets would arrive in another four weeks. Doug was scheduled to begin the installation on July 30, 2010 but he called to say he was ill with food poisoning. He was sick the next two days as well. He began the installation of the lower cabinets on Thursday August 2, 2010 and when I saw them I told him I had some concerns about the color and the finish of the cabinets. I picked up a color sample from another local cabinet maker and asked Doug to bring his sample he had showed me at our original meeting with him on Friday. I compared the cabinet color to the sample and explained to Doug I was very dissatisfied but I wanted my daughter to look at the sample and give me her opinion as she had helped me pick them out. She looked at them when she came home and we both agreed the cabinets he had installed were not what I had ordered. When Doug came over the next day (Saturday), I aksed him point blank if he had orderd my cabinets from Bertsch manufacturing and he said "no". I told him in no uncertain terms that I wanted him to take the lower cabinets he had installed out of my house, order the cabinets I had paid for ($1500 for upgrades and a $2300 allowance from the fire). He said he would do so on Tuesday September 7, 2010 (Monday Sept 6th was a holiday) but that since the factory was on shut down the first week of September, they would be started the following week and ship the last week of September arriving the first week of October. I checked the status of the cabinets with Doug on Monday September 27, 2010 and he said he would know more the middle of the week. I checked status with Doug on Wednesday September 29, 2010 and he did not answer my text inquiry. I sent him another inquiry on Thursday September 30, 2010 and he said he would know something in the morning. He texted me the following morning indicvating that my cabinets would be to him by October 15th and he would start the install on Monday the 18th. He said there was a delay since the plant was on shut down the following week (they are actually not on shut down that week but the week beginning October 18th per my phone call to Bertsch) On Friday October 1, 2010 I took it upon myself to call Bertsch Manufacturing in Waterloo IA. I spoke with Debbie in the Legacy Cabinet department who told me she had no record of any cabinet order for Doug Newby or Newby Design. I called and spoke with Doug and he siad they were ordered through Barker Lumber in Delavan. I called Bertsch back and they had no record of any cabinets under Barker Lumber in either Delavan or Durand. In the meantime, Doug had Rich from Barker Lumber in Delavan call me to verify he had ordered the cabinets. He could not give me a PO number as his "kitchen lady" was out until Monday. I have not received a call from Barker as of yet this morning (October 4, 2010) but I did receive via e-mail a copy of the purchase order indicating the cabinets were ordered last Thursday September 30, 2010 and should be arriving October 18, 2010. I have consulted with an attorney and will be filling suit through small claims if the cabinets do not arrive as scheduled on October 18, 2010. I will also be filing a complaint with the Better Business Bureau. I have had no running water in my kitchen since I moved back home July 30, 2010 since I can not get my cabinets ordered, deleivered ort installed. I have to do my dishes in my bathtub. I am sick and tired of the delays and the lies that this contractor has told me and just want to get my kitchen done and get him out of my house. I will never use this contractor again and would never recommend him to anyone else.
Description of Work: trim work including doors, baseboards etc., moved a wall and tore down a wall, supposed to install kichen cabinets.
