I want this to be posted so that others can see what type of business American Property Management is running. If this is how they treat their tenants that have paid their rent faithfully on time for over 4 years, you can only imagine how others are being treated.
Description of Work: After more than 4 years of very good rental history, on October 18, 2013, we were given 30 day notice to vacate property rented to us on or before November 30, 2013 by American Property Management, Inc.(APM). We were told the owner wanted to move back into the property. We moved out on November 18, 2013, and returned keys to APM on the morning of November 19, 2013. APM failed to return our security deposit and provide us with itemized list of deductions from security deposit within the 30 days(December 19, 2013) required by Idaho Code Section 6-320(4). APM also failed to return pro rata portion(12 days) of the $925 rent we paid defendant on Nov 1, 2013 for the month of November 2013 according to the terms of our lease agreement with APM. Due to violation of the law, APM was legally obligated to pay us the full deposit amount back of $1375. They breached our contract by saying that the owner cancelled his agency agreement with them effective November 30, 2013, and that we had to go to him to get the deposit back. At the same time they were telling the owner that they could not return our security deposit until he signed a new agency agreement on the property the owner was vacating/renting out in Star. APM also stated that it was our decision to move out early so there would be no prorated refund of November’s rent. When the owner did the property walkthrough with them in late November, the owner told APM to refund our full deposit. They never did. He also told them to make sure and tell us not to clean the property because he was planning on gutting the house and doing a full remodel prior to his moving back in. APM never told us this causing us two days of hard work cleaning unnecessarily. These people obviously had spent our security deposit and were unable to return it to us. They also tried to extort the owner into signing a new agency agreement threatening not to return our security deposit until the owner did so. I post this so all can see the type of business APM runs.
