BladesAway (BA)will provide service in three ways and only #1 below requires a signed agreement, (#1) Maintenance Agreement (MA) Scheduled Service for 12 months, with same monthly payment, customer not required to be available at service time, monthly billing and payments mailed to PO Box, –or (#2) Temporary Scheduled Service, – or (#3) Will-Call Service, [no schedule]. Number 2 and 3 requires customer to be available and payment “at service time”, and is generally impractical. I suggested and Mr [Member Name Removed] approved #1 above. Signed Maintenance Agreement (MA), describes Terms of Service by BA, [and includes but is not limited to] Page1 –Bar-Graph of Service Schedule agreed upon, –Charge per service, –Monthly Payment and how it is calculated, –Right to Cancel Service by either party at any time with notice, Page2 –List of Services for customer to select and approve, including a provision to write-in a particular service desired, Page3 –Customer Responsibilities, Page4 –Misc Conditions, Page5 –Common Questions & Answers. Time Line of beginning: 7/06/15 [Member Name Removed] verbally approved service quote, and we set appt for Mon7/13 to sign MA & begin service. 7/13/15 [Member Name Removed] not home, gave me no notice or follow up phone call to me, wasted my time. 7/20/15 [Member Name Removed] signed MA, service began, I request initial payment for one service he gives me payment for two. 7/27/15 service now completed for 7/20 and 7/27 [partial month] and payment received now fully credited. [Member Name Removed] now had 21days from initial quote to -ask questions, -comment on or -cancel MA, and -he did not. SERVICE COST was never complained about until day of cancellation 8 months later, all 8 pymts made on time. If he liked his previous service price so well, then why did he not keep him? There is always someone cheaper. WEED CONTROL: Planters were weeded by terms of our MA “by spraying weed killer, to minimize the presence of weeds”. If you don’t kill the weed root, the weed typically grows back. And if the weed plant is wet the weed killer is likely to be ineffective. While weeds sprayed are dying other weed seeds in the ground are growing. Obnoxious weeds seen from the curb were hand pulled. You never totally get rid of weeds. He appeared paranoid about weeds as they occurred. New weeds can come up between services, especially in the rainy season. I understand he had bad experiences with other lawn services. He appeared concerned weeds would get out of control again, which they did not. A neighbor liked the look of his lawn so well he asked me for a quote. FLOWER PLANT BY GATE: Not until 8 months after service began on the day he cancelled service, did [Member Name Removed] tell me his dissatisfaction with my trimming it and that he had been trimming it, so I did not know how fast it was growing. When service began the plant was overlapping the gate a little and he never mentioned his ‘preference for trimming’ as one of his “customer responsibilities”. Also, plant is too large for the location. UNCOVERING SPRINKLER HEADS was not a listed service to select and he did not request to write it in our MA, however at his mentioning it [within first 21 days mentioned above], I offered to ‘assist him’ in uncovering them, without any obligation to do so, which I did several times, but not to his satisfaction. SERVICE TIME: Service routes are ordered to be efficient as possible so I can be reliable. His location dictated that he would be serviced at the end of the day. Approx two months after service began [Sept 9th] I moved his service time ahead of three other customers nearby [not to my advantage] to address his concern with service late in the day. Which obviously did not help, since he complained here, 6mons later. I never missed a service. LAST DAY OF SERVICE 3/28/16 RETURN OF CREDIT –Celata cancelled 8months into a 12 month agreement, which he has the right to do,– MA pg1 states “BA or customer may cancel MA any time by giving written notice of 15days the first 60days, 30 days thereafter.” – pg5 Common Q & A, states “credit due to customer, by BA providing services for 30 days maximum, but not past cancel date. (No cash refunds)”- [Member Name Removed] did not provide ‘notice to cancel service’ per our MA. He cancelled service the same day he called and said he had already hired a cheaper service. Therefore, there was -no time -to provide service -to return credit -prior to cancel date. If he had only given me 15 days notice to cancel, [though 30 reqd by MA] it would have been sufficient time to return his entire credit. – I have to allocate time, money, resources and establish service routes “IN ADVANCE” to deliver reliable reoccurring service by specific schedules. Based on current commitments, I judge whom I can serve and when. I am convinced that if I had cancelled him without notice, he would not have been a happy camper. “you can satisfy ‘some people all of the time’ and ‘all people some of the time’,– but you cannot satisfy some people at all” I hope Mr [Member Name Removed] is able to find the “perfect lawn service" Thank You Angie's List, for the opportunity of a response, Bill Sims
