We had entertained options to purchase vacant land located on Terra Ceia Island, Florida. We made a decision to contract the land through a real estate company that had it listed for sale and deposited $2,000.00 escrow money with the real estate company. Hence, the land was listed for $175,000.00 and was appraised at $135,000.00. Shane Rogers was the owner/seller of the vacant land and also the president of Capstone Construction Group, LLC., a builder in the area. We decided to welcome some ideas to build a new home with Shane after he had solicited his company Capstone Construction Group, LLC. Shane never provided satisfactory plans to proceed with the building of a new home. The most important criteria included in our plans was a home that would be built in the amount of $650,000.00 which was suppose to include the land. Shane presented plans to us in the amount of $1,100,000.00 which were unsatisfactory. After a period of time and given our extended patience Shane presented plans in the amount of $780,000.00. We decided to move forward with Shane and our plans to build a new home and proceeded to seek financing via multiple banks. Because of the economy and the appraised value of the home being $500,000.00 (we had two appraisals from different companies with good faith to continue our ventures) we were unable to secure financing even with our intention to pay any differences out of pocket that may have been needed. We have excellent credit and ample money for down payments and closing costs, etc. And we were able to verify everyting with the banks including employment and income. We never signed a construction contract and we were never reimbursed a penny of the $33,000 deposit monies. We were willing to pay the the architect and wanted to be reimbursed the difference of the deposit money. When we appraoched Shane for an explanation he was callous and hostile. The real estate company DID return our $2,000.00 escrow money.
