Mr. Eric Hess is being turned into the Florida Division of Real Estate through the consumer complaints section and Standards of Practice II, on all three counts. A list of the Code of Ethics Violations which occurred in this "transaction" can be found below. Additionally, your realtor is required to run all contracts through the proper channels as agents have a duty to: Disclose All Sources of Compensation. Additionally, I am filing a complaint with HUD for discrimination as a disabled, single female as well. HUD has recommended that I don't wait any longer and file with the Division of Real Estate immediately regardless of the pending litigation surrounding the lawsuit which this transaction has caused. Eric Hess, attempted to remove me from my neighborhood and home by price-fixing my home and discriminating against me along with a group of men in my neighborhood. Mr. Hess is now listed as a witness, due to his involvement, in the lawsuit which has been going on since the contract was written in February of 2015. Once the current litigation has resolved, my intent is to file suit against Mr. Hess to recover the financial damages, along with damages for personal and mental duress caused by his actions. Description of Work: Eric Hess was interested in generating a contract on my home to finalize a split between my partner and myself as we each owned half of our home. I decided I wasn't ready or up for it mentally and physically and declined negotiations after it became too much. Eric continually called and pressured me to begin negotiations to buy out my ex-partner. He attempted to get me to agree to a price agreement in order to negotiate with the other half owner of the house. I am a single, disabled female and I began feeling bullied, pressured and pushed to get involved in a contract I was not prepared to address. Unbeknownst to me, he had been sending information regarding my home to the other owner of the home. Mr. Hess was greatly overpricing and marketing my home against homes of NO equal value. I understand this type of information as I still maintain a real estate license in another state. The practices of Eric Hess surrounding my home as a licensed Broker were unethical and deceptive. He had convinced a group of men the value of the house was much higher than it's true value. I had two appraisals which were almost $100,000 less than Eric's market analysis which he was only sending to my ex partner. All information was being kept from me. In February of 2015 Eric Hess prepared documents with a group of men at a neighbors house in an attempt to force me to sell my home. My home was NOT and still is not for sale 1.5 years later. Eric Hess wrote a contract in an attempt to sell my home.

I take this very seriously. HUD decision below no money was accepted DETERMINATION OF NO REASONABLE CAUSE [Member Name Removed] v Hess Realty & Development Corp., et at 04-17-5833-8 The investigation failed to substantiate the allegations as the evidence did not corroborate Complainant's assertions that Respondent Hess treated her differently based on her s** or disability or that Respondent Hess tried to pressure her to sell her house. Specifically, the investigation revealed: • Complainant owned the subject property in joint tenancy with her ex-boyfriend, D. [Member Name Removed]. • Complainant asked Respondent Hess for advice on how to acquire Mr. [Member Name Removed]'s share of the subject property from him after their break-up in 2014. • Respondent Hess suggested Complainant attempt to reach agreement with Mr. [Member Name Removed] with regard to the sale or purchase of his or her share of the house. • Respondent Hess assisted Complainant in having the property appraised as per her request for assistance. • Complainant believed Respondent Hess valued the property at too high a price. • The court subsequently approved the sale of the house to Mr. [Member Name Removed] at the price estimated by Respondent Hess. • The evidence could not support the Complainant's assertions she was improperly harassed.
