Hello Mr. [Member Name Removed], We are sincerely sorry that the outcome was not what you were hoping. I would like to clarify a few things yes, Pierce Fence had a CONTRACT with your neighbor, when someone signs a contract with terms and condition it makes it a legal document. Your neighbor agreed in writing that he/she would be responsible for knowing where their property lines are, as well as taking full responsibly of any damage that can occur to unidentified private utilities while digging. We do not just one day show up to someones property and have our crews install a fence any where they please. Our customers meet with a salesman and they must show where they want the fence installed. They are completely responsible for knowing their property lines or calling a professional surveyor beforehand. You stated that you had to get a survey completed, so that tells us that you disputed the location of the fence with your neighbor (which was made aware to us 5 months after we installed the fence). We are a third party that is not aware of your property lines nor your neighbors, all homeowners are responsible of knowing their property lines. You paying for a survey to identify your property lines is a dispute with your neighbor, not us. Once we were made aware that the fence was over our customer's property lines we followed protocol. We realize that you did not have a contract with us, we wanted to have courtesy of that and in turn made a claim to our insurance company to see what could be done. It was determined by the insurance company that we could not be held liable for any damage and it would be your neighbor's responsibility because he misidentified his property lines. It is unfortunate that this has happen to you, we understand your pain and did attempt to rectify the situation even though it was out of our control. The issue at hand is between neighbors. Your neighbor assumes all liability when he/she signed a contract for a fence installation. You rated us as an F for "quality" and "responsiveness", with all due respect the quality of our work was not a service you had. As for responsiveness to the matter, that to was handled in a timely matter, was it the outcome you were looking for, no, but it was addressed. Again we apologize for unknowably being directed over our customer's property line and damaging your private line while digging holes. We are sorry that a legal contract is being blatantly disregarded by the responsible party and we hope you accomplish having your invoice paid. If you would like a sample copy of our contract and terms/conditions to help with that matter, we would certainly do so. We are a small family business that as served the area for 47 years and we thrive to keep all of our customers happy and do what we can. It pains us when situations like this are out of our control, due to the current situation our hands are tied and we must follow the contract. Take care.
