Front Range Sheds

Contracted with Joel for a shed. He presented a very good timeline but was no where close to it. He does not show up when scheduled, when he did show up he did minimal work than left. The shed was proposed to be completed the 3rd week of Feb and actual completion was in April after I went to Better Buis Bur. Very poor communication. Quality of shed is marginal-I have hired someone else to reinforce. I wish I had researched Angies List and BBB first as he has other F ratings. DO NOT RECOMMEND

I found Joel Tomcheck on Craigslist. I signed a contract on January 21 and gave Joel $550.00 to build a 5x 10 shed. Upon signing the contract and giving him the money he delivered some shingles, two by fours, and a window. He stated that he could begin work the following Friday. That was two months ago. In that time, he worked maybe 10 minutes. I had a deadline to meet. I informed him. 3 times of the deadline. Each time he reassured me that I didn't need to worry and he would be on it the next week. Finally, I informed him that if he did not begin work on the project by the end of the week, I would need to find someone else. He did not show up and again told me that he could maybe start on the project the following Tuesday if weather permitted. I informed him on March 22nd that I could wait no longer and I wanted him to remove his materials and return my down payment minus the 15% for canceling the contract. I have not heard from him since. It is April 1st and I have not seen a penny and the useless materials are sitting in my back yard.

I signed a contract with Front Range Sheds on 4/17/12 - and gave him a deposit check of $550.00 Mr. Tomchek delivered some materials -stating he would be delivering more and starting construction the next morning. On 4/18/12 he never showed up even after numerous calls from me to him and him stating he would "Be right there", and again stating that evening he would be there "first thing the next morning". On 4/19/12 he did not show up in the AM, after numerous calls from me to him and him stating "I'm on my way" and I'll be there in 15 minutes" he did not show up until 4PM and then brought in 2x6 Trex decking materials to build a structural base (Trex specifically not designed for structural applications - ICC-ES Evaluation Report ESR-1190 Section 5.1) he nailed 4 pieces of Trex together and left before I could get there. He was there about 1 hour. He called and said "Your base is all done, I'll be back first thing in the morning to finish the shed". He did not arrive until 11:17 AM - I went to meet him and he did not work, he said he was going to get a sandwich and would "Be right back" - he never came back. I tried calling him to no avail - finally at 4:20PM I called and left a message telling him "I am cancelling our contract, I do not want you back on the premises and will report it as a burglary, and I request the refund of my deposit of $550.00 ASAP." He refuses to return my deposit check and states that If I pursue any more action to have my funds returned, he will attempt to collect additional monies from me. Consumer's Desired Resolution: I would like my deposit refunded and Front Range Sheds / Principal: Ms. Joy Anne Lee (Owner) /Mr. Tomchek can have the materials back. It is a common project. Additionally, the materials that were delivered later, on 4/19/12, the Trex decking material, were NOT approved and would never have been approved as they we being utilized outside of their specified usage criteria. The cancellation fee for CUSTOM projects does not apply. Regarding the $550.00 deposit: The $550.00 dollar payment (see attachment #5) was the 1st payment, a deposit, as it clearly states on page one, section 4 of the contract. The contractors' attached delivery receipt (See contractor uploaded .pdf page #2) only lists "Grey Shingles". No grey shingles were ever delivered to my address. The materials delivered do not amount to $550.00 worth of materials. The Contractor completed 15 minutes of labor on site. He nailed four Trex decking boards together. (See attached pics) Front Range Sheds advertisement indicates the company is: "a local company licensed and insured in Colorado Springs for 16 Years". (See attachment #2, Craigslist ad) I spoke with Pikes Peak Regional Building Department who informed me that the contractor is not licensed in Colorado Springs to perform construction. The company does not have a business license with the city if Colorado Springs. The company would not or could not provide a Certificate of Insurance. The construction of the structure was outside of generally accepted building codes: The structural base of the building in question violates the approved usage criteria set forth by the manufacturer. (See attachment #4) Regarding the 'delivered materials': I was told that all materials to be used were 'new' materials. Contractor made subsequent delivery of materials when homeowner not present consisting of used Trex 2x6 decking material. Contractor delivered obviously old and used materials and was using those materials to begin construction.
