Scott did a good job selling my old house and I give him credit for that. But when you really get down to the facts I did most of the work selling my home. The first buyers to look at the house made a lowball offer which Scott tried to pressure me into accepting. When I refused he became a little irritated. I told him not to worry they would be back. In fact they were, returning on Saturday less than a week later. Scott was unaware they had returned even though it was his service that let them in. After I made Scott aware of their return he tracked them down and submitted a substantially better offer. I accepted and asked Scott to leave me alone. I would pay the entire 5.6 percent commission that he could share with the buyer s agent but I wanted him out of my life and the deal for my new purchase. His secretary inundated my fax with paper after paper defending Scotts position as the Brokering Agent and said there was nothing I could do about it. I am left dealing with inspection items, closing issues and faxes between everyone s realtor but mine. I have to set up visits for the buyer of my home, and speak directly with the Seller's realtor if I need anything with regard to my new home. In the mean time Scotts staff has been rude to my wife, my inspector and mortgage broker. He doesn t keep in touch with me via email or voicemail as I have instructed. It's as if he doesn't exist. All of these problems and I can't fire him. I spoke to the Real Estate Commission and they said it would take a minimum of 21 days before they would even have a chance to look into my complaint. So I expect no relief from them. This has been one of the worst experiences of my life and has only touched on the variety of issues involved. Believe me; this has been a nightmare.
Description of Work: Scott was referred by home builder through an incentive program. The first time Scott and I spoke he promised the world--it really sounded too good to be true. So I didn't sign the Sellers/Buyers Agreements that day. He promised he could get the new home builders to eat the losses on my old house, pay a 6% co-op and give me a complete front and backyard landscape. After close he would give me half of the co-op which would have been around 15K. Instead he couldn't get the new home builders to budge so he moved to plan "B" which involved pressuring me into financing 25K into the new home purchase price so that I could draw 15K at the back end. This was a deal I rejected immediately. So we, my wife and I began to include resale homes to our search. Finding one we liked and wanted to make an offer on we couldn't get Scott over to the house in a timely manner. In fact it has been about 3 weeks and Scott has still not seen the house. Four days prior to inspection he informed me he would not be there as he found them to be a waste of his valuable time. He said "I normally just spend time sitting around talking to my client. After the inspection he badgered me into telling him the "important stuff" found at the inspection. As I began talking he cut me off and reiterated "just the important stuff". I told him I would have to go over the document and video to narrow down the important stuff. A little while later his secretary, Lee, called me to inquire as to whether I had come to a conclusion on the "important stuff" I asked her to have a runner come to my home and pick up the inspection report which was approximately 90 pages--make a copy and return it to me. I also mentioned that if Scott or one of his representatives were present during inspection none of this would be at issue. She gave me some excuse as to how Scott was sick that day and couldn't make it. I told her Scott had informed me 4 days earlier he wasn't planning on attending the inspection. Did he know he was going to be sick that day? If so why not tell me; hey I can't make it to the inspection, I plan to be sick that day. Lee got very snappy with me, a client, telling me to stop yelling. I can assure you I was not yelling; just speaking mater-of-factly. I thanked her for her time and ended the conversation. Since then I have had minimal conversation with Sabina and Company. Scott has made no effort to correspond or collaborate with me in any way. In the mean time he stands to gain 15K commission from the deal. I have tried to fire him as I didn't sign a buyers agreement but for some reason he has become the Brokering Agent. As it really stands the other buyers and sellers realtors have collaborated to "take care of me". While I like these people they are bound contractually to serve their clients. I essential have no representation and I close 2 homes on 12 June.
