I first contacted European Roll Shutters in early May, 2013. The roll shutters go on the exterior of the house, have slats like venetian blinds. The coloring of the slats is due to some sort of baked in process like powder coating. There is a box over the window/door/section covered by the shutters. The shutters roll up into the box when the shutters are open. I was expecting company mid-summer and wanted the shutters installed by then to provide privacy for my guests. On July 19, 2013 I finally had signed a contract for two window shutters with the smaller slats and for three sliding glass door shutters with the larger slats. My trim, windows, doors, storm door, screen door, lattice work, garage door, gutters are all white white and I ordered white white shutters to match. On August 20, 2013 a crew showed up to install the shutters. Immediately upon their starting to open the covering enclosing the first shutter I asked what color the shutters were because the shutters did not appear to be white. I was told that the shutters were beige. I said that was the wrong color. When the boss arrived he told me that the contract specified beige and I was changing the color of the shutters. The contract does NOT specify a color. He tried to talk me into the beige because the white white shutters would glare too much. The shutters were to be on windows and doors on the back side of a covered deck set in a space surrounded on three sides by house. There would not be any glare. My rear decking, stairs and railings are all one color. My stucco is one color. My trim, windows, ... are all one color. And NONE of them are beige! Eventually, he said he would get the white white shutters and the shutters would be ready to install in a month. ~September 24: I call to make an installation appointment. The owner answers. The shutters are not ready; they could not find anyone who would paint the shutters and guarantee the paint job. Owner wants to know what did I expect since I changed the color. I believe that legally, European Roll Shutters, LLC, the writer of the vague contract is responsible for the problems resulting from the contract's vagueness. Per the owner, as a young man he bought a bankrupt company, developed it, was making $90,000 a month, sold the company, retired at 35 to spend his time with his family, has all the money he'll ever need. He is German, an honest straight talker like most Germans, not like the Americans. Owner is in town, without benefit of the company of his wife and kids, to fix the problems with his shutter company and is working long hours to satisfy his customers. Owner makes an appointment for 8/26. September 26: Wait and wait so more for owner. He can see that all the trim is white. He goes on and on about his Colorado Springs manager, placing all blame on the manager, accusing his manger of theft -- NONE of my business. I am only interested in the shutters. But he just keeps on going, telling me to shut up until he is done. Based on ACTUAL problems encountered by prior customers of European Roll Shutters, I have concerns: 1. any untreated wood used in the installation needs at the least to be primed -- He says, of course, otherwise the wood will rot. 2. sufficient slats in the shutter -- He says, we assemble the shutters in our work shop so that will never happen. 3. I want the master bedroom remote to be able to individually control each of the 3 motorized shutters. He cuts me off again. He is going to write a new contract -- not amend the existing contract with the consent of both parties to each amendment. October 3: I get the 'new contract'. All remotes are quoted as one channel remotes; the sales tax is incorrect. 200R slats and color #16 white are quoted without clarification of which size slat and which white color is being quoted. No mention is made that the electrical work including the moving the light is included nor of a warranty. The potential 'new contract' is both vague and incorrect. I email a reply. Per legalmatch.com: A contract is a legally binding agreement between two or more parties. It is usually a written document that outlines the duties and benefits that are prescribed to each party. ... Contract modification occurs when the parties agree to change any of the terms in the original agreement." October 4: The owner unilaterally voids the contract. Per his email: "the price of the material, what we had to order for you is twice as much as the standard material what we have in stock. ... I even changed the remotes for 4 channel remotes, even these are more expensive." (The contract in the email still shows all one channel remotes and I have heard nothing previously about 4 channel remotes.) "... if you have lost faith in my word, than we lost the basic to do business with each other ... I will send you a refund of your down payment this weekend." (A contract, clearly defining the obligations of each of the parties provides protection to both parties and is a good basis for doing business.) I email a response to the owner ending with: "I am looking forward to having the shutters included in the current contract installed in a timely manner." October 9: In an envelope postmarked October 7, I receive a a refund of my deposit. I first contacted the company in early May. I made the 50% down payment in July. In October I still have NO shutters.
Description of Work: FYI: Ownership has changed. 'Standard shutters' are now made with the smaller slats with less insulation. Provider failed to provide the shutters or do the shutter installation. Early May, 2013: I contacted the company. I was told there was a three week wait for the shutters. I said OK, let's get them ordered. They said they would call in three weeks. An appointment was made for May 23rd but no one showed up. I called and learned that the salesperson had just put his daughter in an ambulance. OK, valid reason. Let's reschedule I'll be leaving for a month and would like to come home to a shutter installation. No, call them when I get back. June 28: Made appointment for July 3rd . July 3: I wait, eventually I call them. Salesman is on the way, traffic is bad. Salesman comes, measures, answers questions. Will send bid. No bid shows up. I call them. The bid was mailed last week, but they will email it to me. Sales tax rate appears to be incorrect. I call the state; because we do not have bus service, our sales tax is 1% lower than the rate on the bid. JULY 18, 2013: Bid is resent with correct sales tax rate. Contract is vague, call up and get clarifications. CONTRACT IS SIGNED AND REQUIRED 50% DEPOSIT IS PAID. August 20: Installers show up with wrong color shutters. Installers say wait for boss. Boss says did I not read the contract, the contract specifies beige shutters. The contract does NOT specify any color. I specifically requested WHITE WHITE not OFF WHITE. House windows, doors, gutters, trim, garage door, lattice work, screen doors and storm door are all WHITE WHITE. Nothing on the home's exterior is beige. Boss says he will get the white shutters and the shutters will be ready to install in a month. ~September 24: I call to make an installation appointment. Owner says that the shutters are not ready; they could not find anyone who would paint the shutters and guarantee the paint job. I am appalled -- the color of the shutters is due to a baked in process like powder coating. These external shutters are subject to wind, rain, hail, ... When open, the shutters are rolled up inside a box. Owner wants to know what did I expect since I changed the color. The shutters may be a quality product but after painting the shutters would NOT be a quality product. This company has a definite lack of concern for quality. Owner is in town taking care of company problems and trying to satisfy his customers. Owner makes an appointment for 9/26. September 26: I wait. I call the company. They are surprised owner has not arrived. I wait. Owner was too busy, time just slipped by. Salesman's original notes show both beige and white. Owner can see that all the trim items on my home are white. My contract specifies shutters with the smaller size slats for two windows and shutters with the larger size slats for three sliding glass doors. The owner does not appear to like having the different size slats. He will give me a bid for 'upgrading' the small slats to the larger slats. OK. Later he calls and verbally offers to upgrade the two 2.5' * 5' (~25 total sq.ft. for both shutters) smaller slat shutters to larger slat shutters for something between $350 and $400, more than $14.00 per sq.ft. I have the original bids for the three sliding glass door shutters (6' * 7', 7' * 7' and 8' * 7', for a total of ~147 sq.ft of shutter) both as small slat shutters and large slat shutters. The difference in cost to 'upgrade' ~147 square feet is ~$426, a little less than $3 per sq.ft. I declined the window shutter 'upgrade'. The owner later offers the upgrade for free -- at $3 / sq.ft, this 'upgrade' is worth ~$75. October 3: I receive via email a "NEW CONTRACT" instead of a list of possible changes or additions to the existing contract. The sales tax is incorrect; remotes for the all motorized shutters are specified as 1 channel remotes. Before signing the original contract one of the clarifications I received was that each remote would had six channels. Having signed the original VAGUE contract which failed to specify the color of the shutters and then been accused of changing the color after the fact I was certainly not going to sign another such contract with the same company. I have been told that legally, the writer of the vague contract can be held responsible for problems arising for the vagueness of the contract. I email back some additions and corrections I would like in the contract. October 4: The owner, without consulting me, the other party to the July contract, voids the contract and says he is refunding the deposit he was had since July 19, 2013. I reply by email. I explain much of what I have just written and conclude with "I am looking forward to having the shutters included in the current contract installed in a timely manner." On October 9: I received a refund of the deposit made in July in an envelope post marked October 7, 2012.
