Prosperity Landscaping & Tree Service

On November 5th 2017, our neighbor hired Prosperity Landscaping & Tree remove trees on their property. While doing so, a tree trunk fell on our property, damaging it. We spoke with the business Owner, Don Ballez, and requested insurance information. After no receipt of this information I requested it again. Once again, no insurance information was provided. We tried working with Mr. Ballez to resolve and repair the damage to our property for 4 months. After no resolution was reached, we decided to contact our insurance company. On April 3, 2018, I was notified by USAA that the subrogation process had started. On October 5, 2018, we received a letter from our insurance company stating that they were working to recover damages from Prosperity Landscaping. On April 1, 2019, we received a letter from our insurance company stating that they were unable to recover any money from the responsible party. On November 4, 2019, we took Prosperity Landscaping & Tree to court where Mr. Ballez agreed to pay $1200 in 4 installments of $300. We have received $600.00 and have mailed Mr. Ballez requesting the final payments. We have not heard nor have we received these final court ordered payments.
