On June 13, 2018, in a follow-up telephone call to my letter dated May 9, 2018 to Environmental Molding Concepts, 14050 Day Street, Moreno Valley, CA 92553, I spoke to Daisy Rivera, Inside Sales Manager, regarding my letter of May 9, 2018. Daisy indicated that this was "out of her control", and that the file had been forwarded to the VPs for addressing. She would not provide their name(s) to me for follow-up. As of this date, I have not heard from either Daisy Rivera or the VPs of Environmental Molding Concepts regarding the warranty of the Outdoor Play and Patio Tiles. This product was installed, according to the manufacturer’s instructions, on the roof top deck at our home in Englewood, Florida, in March/April of 2014. Shortly after the installation of this product was completed, we left our Florida home at the end of May, 2014, to spend the summer in Minnesota. Upon our return to the Florida home in October, 2014, I started to document and send photos to the Vendor from whom we purchased this product, David Butler, President of Greatmats Corporation, of the blue pigment that we were experiencing coming off of these roof top tiles onto our deck furniture, shoes, bare feet, clothing, Travertine tile, our dog’s paws, etc., during the use of the roof top deck. In speaking with the Vendor, David Butler, President of Greatmats Corporation, regarding our concerns, he commented that the loss of pigmentation was due to “normal or excessive use”. While “normal or excessive use” of this product will be deemed as an exclusion of warranty coverage, per the warranty policy, I indicated that due to our absence from the property, in excess of four months after the product’s initial installation, and upon my notification to David Butler of this issue beginning in October, 2014, the exclusion of warranty does not meet the criteria of “normal or excessive use”, simply due to the fact that we, nor anyone else, would have contributed to the “normal or excessive use” of the product under warranty, because no one was living at the home from the end of May, 2014 to mid-October, 2014. The warranty policy states that the “product will be free from defects in material and workmanship (subject to limitations…normal or excessive wear and tear of product, etc.) for a period of five (5) years from the date of purchase from the manufacturer or its authorized dealer. I believe and support the fact that this material/product is defective. In addition, several of these tiles were recently removed in a small area from the roof top deck. Upon inspection of this area, the blue pigment bled through onto the white rooftop; and while stepping in and walking on said area, the blue pigment did stain the soles of our shoes, socks and even our bare feet. We have been unable to use and enjoy the roof top deck due to the defective product. The attached photos show the pigment coming off onto the deck furniture, shoes, bare feet, clothing, Travertine tile, the dog’s paws. I have made several attempts to contact Environmental Concepts, both by U.S. certified mail, return receipt requested, and by telephone, however, to date, no one from Environmental Concepts have responded to my repeated requests for contact. Attached is a copy of the five year Warranty regarding this product.
