The initial job went well with the install. After that it went to h***. The owner left to get married in the middle of the job. When he returned we noticed the color was wrong. He came out with his worker and agreed that the color was wrong form the sample that we signed for the walnut color. He never installed the treads and risers that were part of the job and told me that he would not return my property unless I signed a release stating I would not sue him for not finishing the job. I then contacted the Contractors court and they in turn sent their floor specialist and he wrote the report stating it was our fault the floors were in such bad condition and we should have taken better care. My question to him was. If the finish is wrong and it started coming off six months after it was applied then what options do we have in taking care of the floors when again they were done improperly. (Just a note they used min wax to stain and finish on the floors. Not the proper finish for 2500 sq ft of hardwood flooring. He also agreed that he should have used another product, but since he left the finish job in the hands of his workers he would redo them. This went on for almost a year and after the initial contact with the Contractors Board he recommended we contact the bonding Company. We moved forward with the bonding company and they gave him 21 days to respond to our complaint. He never responded and the bond company made a ruling stating. The signature on the wood did not match the signature on the contract and the sample showing the wrong color was not sufficient to prove the floor was stained the wrong color. To date we have not had the treads and risers installed that we paid for and the contractors Board and the Surety bond company are closing the case. Furthermore neither the bonding company or contractors board have had a conversation with us and in any court of law when the respondent does not reply to the complaint then the respondent loses by default. In this case we lost even though the flooring company never responded to the bonding companies request. They took the flooring companies owners word, the reason he could not redo the floors was because we had a big dog, and the floors were in such bad shape he could not repair them, and we were doing landscaping in the front of the house and he could not enter the property and his schedule was so tight he didn't have time to finish the job.
