I think the best way to describe them is to copy and paste my letter to states Attorney General and a few state legislators I know. Mr. William Edward Dew and whom it may concern. This email is to inform you that Mr. & Mrs. Clendenen has stopped payment on her most recent check to your company in regards to the air conditioning service they received on the day of March 28th 2013. After reviewing the work attempted by your staff, the either lack of industry knowledge or outright lies by your staff, the replacement of parts still in good working order, the lack of ability or due diligence on your staffs part to safely mount all electrical parts and the false indication of inspection and testing of all parts when in fact no inspection or testing had been completed are the reasons they have stopped payment. You should also be aware that a complaint has been filed with the States Attorney General?s office, a formal complaint with the Arizona Registrar of Contractors is also underway, as well as ongoing correspondence with several Arizona State Representatives and local media. Should you need to contact Mr. or Mrs. Clendenen for any reason you may do so through their attorney listed below. Bacho Vega, Attorney at Law Dodge & Vega, PLC 4824 E. I know exactly what a capacitor does, how it works, and how to test it. I have since purchased four replacement capacitors and installed them myself to get their crap out of units and return it to them. It also only took me 26 minutes to replace all four. With shipping and tax they cost me $114 from Grainger and I bought the more expensive, US made ones instead of the cheap made in China crap they put into my units. Update #1: This company also does business as M Drive Enterprises, Inc and has filed a preliminary 20 day lien notice against us. They contacted our lawyer and said they wanted their parts returned and he provided them with our phone number but they never called to setup a time to pick them. They remain in my garage in a box waiting for them to come and collect their parts as I have no use for them. Update #2: My attorney had me include another small piece of information in the email/letter I sent back to them and it might be useful for others who find themselves in a similar situation. Apparently if you file a lien and have done so fraudulently there are penalties. "Please be on notice that should you proceed with the filing of this WRONGFUL lien we will seek sanctions against you including but not limited to a minimum penalty of $5,000.00 or three times the actual damages, whichever is greater, plus attorney's fees and costs in pursuant to ARS 33-420. All correspondence and materials is also being provided to the States Attorney Generals office." Update #3: I know the general rule is to always seem pleasant when sending an email, as my attorney said, you want to look like you are the reasonable one. But I honestly can't come up with a valid reason that I have to be nice in my emails to these scam artists. They have nothing I want, the more I upset them the more they say. I will leave off all the email addresses on the email chain as some of them are personal or private email addresses of public officials. But in the latest round of emails with these clowns I didn't hold back too much on how I felt about them and it really upsets me that these people are ripping off families every single day here in AZ. And it will be months or years before anything is done. In my latest reply I am replying to their email back to me explaining how they are the victims and I am holding their capacitors hostage, all they want to do is get their poor defenseless parts back so that they can use them to rip someone else off. This lady that replied wouldn't know the truth if it bit her on the nose, so here email is full of lies but it is rather humorous. Here is her reply to my email at the bottom of Update #2. On 4/2/13 our bank account showed that the Clendenens? check had been returned. It was still in processing so we didn?t know why it was returned until the 3rd. We notified Dan the tech on the 2nd. He was unable to reach them by phone. On the 3rd we also received the e-mail from their attorney. Prior to this we had no idea that there was a problem. In that e-mail we were instructed to only make contact through their attorney. At that time I called the attorney and left a message with a girl who answered the phone for the attorney to return my call. That afternoon the same girl returned the call. She wanted to see why we called. I informed her that we had no problem retrieving our parts and waiving charges. She said she would relay the message to Mr. Vega and the Clendenens and someone would contact us. No one did. In order to preserve our rights on 4/11/13 we filed an intent to lien, which was signed for by M. Clendenen on 4/16/13. On 4/22/13 we received an e-mail asking where to send a reply to. On 4/23/13 I called the Clendenens. I first attempted to speak to Mrs. Clendenen who would not listen and said that we were told that we could come and get our parts out of the garage. I tried to explain that the only contact we had was from the attorney telling us to only make contact through him. At that time a male voice (Mr. Clendenen?) came on the phone and said, ?That?s right! Contact my attorney? and hung up. Then we received an e-mail from their attorney threatening us with a $5,000 penalty. From the beginning and through this whole thing (and still) we have been trying to retrieve our property (since payment was stopped on their check I believe the parts would still be our property) and waive payment in order to resolve this issue in the interest of good customer relations. However, to date, we have been unable to communicate with anyone reasonable enough to allow us to do so. Your employer is clearly running another scam and you are part of it and I am sure based on your criminal history no one is shocked to find you are working a scam. People like you and your employer disgust me. We have mailed off the reply to your preliminary lien and my wife will contact you to schedule a time for you to come and collect your parts. Fortunately for Arizona I am not the type of person who is afraid to make some noise and to stand up for what is right. I will enjoy watching and assisting as the state of Arizona and any other government agency or law enforcement department prosecutes you and everyone involved. Your companies negligence could easily burn down someone?s house and kill people in the process and I am shocked that it hasn?t happened already. My wife answered the door and about a minute later she asked me to come down stairs. I went down and their was some technician standing on the porch and my wife was next to the door. She proceeded to tell me that they refused to take their parts back unless she signed some document stating that she would not pursue any claims against them and stop complaining to the state about them. So I said "okay." And I slammed the door closed in his face. Took his capacitors and put them back in the garage and called my attorney. He advised me to ship them to them, making sure they had to sign for them and to keep the receipt. So that is what we did. I am still putting pressure on the AG's office to do something but I know they have more important things to do, I wish I could get the media involved but they haven't responded. Every day that passes these clowns are stealing more money from people and I just hope I can get it to stop soon.
