stole $2000. from me and will not answer his phone or email

horribly. I paid him half upfront, $2965.00. He removed most of the rocks and dirt in my front yard and placed it in the road. He didn't come back for 2 weeks. Plastic and dirt blowing all over the neighborhood. He came back by himself with a small shovel and worked an hour and a half and left. Very unprofessional attitude. I gave him a second chance, still never came back. He said that I need to pay him $965 for work done. (too much) and that he would give me a refund of the $2000. I said ok. He promised to give the refund back to me (I paid a cancellation fee also). This was 3 months ago. He said that he doesn't have the money. I have to take him to small claims court. Won't answer phone or email. Disgusting customer service!!
