It has been the most horrific experience of my life causing me and my family undue stress and financial burden. I have a mission now as a member of the general public to change legislation associated with the Registrar of Contractors. I maintain that the Registrar of Contractors must submit to the public the criteria that they use to deem a person is of "good character and reputation." GIven this criteria, the general public can then make the decision to do further research and due diligence on any General Contractor that they hire. The Association of Realtors, for instance, provides this criteria to the general public. The Registrar of Contractors should be mandated to do the same and to fulfill their mission which is "...to promote quality construction by Arizona contractors through a licensing and regulatory system designed to protect the health, safety and welfare of the public."
Description of Work: I hired Matthew G. Nisbet to be the General Contractor on the remodeling of my home. I have currently taken my complaint for numerous code and workmanship issues to the Registrar of Contractors. Mr. Nisbet has been issued a Corrective Work Order by the Registrar of Contractors and has not yet completed any of the corrective work order within the mandated 15 days. This work needing correction was cited by the City of Phoenix Development Services as code violations. In short, this is the most horrific experience of my life resulting now in legal action to collect any monies that I am currently out of pocket. In addition, work on the home has stalled for months resulting in further losses. I wish to ensure what has happened to me does not happen to any other members of the public Make SURE to check not only references of any General Contractor you hire, but do a COMPLETE criminal background check on your General Contractor. This can be a lot of money you will be spending and you need to be careful. In addition, you are inviting this person into your home. Criminal records are public information and available online. The Registrar of Contractors does not guarantee that any General Contractor does not have a criminal record or even a felony conviction for that matter. The General Contractor could very well have a criminal record as was the case with the General Contractor that I hired. Again, this is all public information and you should do your due diligence. I sure wish someone would have told me to check the criminal record of the General Contractor that I hired. I maintain it would have saved me a great deal of pain and suffering with this experience. I somehow believed that if the General Contractor was licensed by the Registrar of Contractors in the State of Arizona, that somehow he had a kind of "Good Housekeeping Stamp of approval." I was very, very WRONG! The Registrar of Contractors has the discretion to determine if someone is of "good character and reputation" during the licensing process of General Contractors. There is currently NO criteria for how they determine this. So, a criminal record of felony aggravated assault with four years in prison (with release in 2002) and numerous other criminal convictions will sometimes not override what the ROC determines to be "good character and reputation." In this case, this General Contractor was issued a license by the ROC in 2009 and is currently contracting in the state of Arizona.
