My Sister in law is a Realtor out of Arkansas, so when she found property that we end up putting an offer on we chose to use the selling agent as a Dual agent, because my sister in law in not licensed in Missouri. We put in an offer for the asking price of 96,000 with circumstances I had a large settlement coming and had the lawyer of my trust draft a letter stating that the funds were there, but we did not have an exact date of when they would be released so we would need an open date for closing. She took that offer to the Seller and all terms were agreed on, on by both sides. We took possession of the property and signed a years lease stating we would pay rent monthly until we were able to close on the property. It was about 25 days later when Kelly called and asked if funds had been released yet. I informed her that they hadn't and she said we would just put a different closing date, even though we had agreed to have an open date. A few weeks later I was informed that she had called a friend of hers at a bank that she uses and told them that we would be coming in and applying for a loan, and gave them personal information about my finances with out me knowing. In other conversations with Kelly Reed it had occurred to me that the seller was pushing for a closing date. Kelly then proceeded to call me at least twice a week telling me that if we didn't get a closing date that she was putting the property back on the market and we would be out our earnest money. But they would keep us committed to the year rental agreement. After going to our personal bank and getting a loan, Kelly Reed set the closing date for December 20th 2012. While at the closing table and signing paper work I asked Kelly Reed about the title to the house that was on the front of the property. I was then informed that she (Kelly Reed) did not have the paper work or the title ready for the house on the front of the property, but would get it to us as soon as she had it ready. It took about two weeks before she had the title ready for us to sign. And informed me that all I needed to do was mail it off. which needed to be done immediatly because she dated the title for dec 20th the original closing date, even though we didn't get the title for several weeks later. Nine days later I got the title back from Jefferson City informing me that it had not been done properly and that an $11.00 application fee needed to be paid. I went to the license bureau and paid the fee and sent it back to Jefferson City. It then came back telling me that the title work still was not done correctly. I then called Kelly Reed and let her know that I was still having trouble with the title work, and that something needed to be done because now it was three months later the title work was still not correct and I was being penalized $75.00 for late fees. While talking to Kelly Reed she informed me that I had made out good on the property and I should call Jefferson City and get it taken care of myself. Which is exactly was I did. I paid the 11.00 application fee and the $75.00 penalty that racked up because Kelly did not do the paper work right. In this time the seller of the property had come for what was supposed to be the starters of her flowers( which was agreed upon in the contract . ) Instead they dug all the bulbs out of the flower beds and took a wind mill from the property. I then called Kelly and informed her of what had been done and was told that she would call the sellers and let them know that was not in the contract to do. After two days of not hearing anything from Kelly Reed I then called her back and told her I was fete up with the situation and her non action of anything and that she had 24 hours to call me back or I was calling her Broker office and the State Realtor commissioner and reporting her. The next evening Kelly Reed calls me back and says she did not like me calling her and threatning her. ( In no way did I threaten her , just informed her of the actions i would take if something wasn't done about the situation) And gave me the phone numbers to her brokers office and the state commissioner. and all but told me good luck. This is the fourth property my husband and I have bought, and by far the the worst realtor we have ever had I would strongly suggest any person buying or selling property in Arkansas or Missouri should not use Kelly Reed from Coldwell Banker Harris McHaney & Faucette
