They cancelled my contract due to work stoppage. We had an agreement to the work stoppage due to the concrete layout being incorrect. They now have $30,000 of mine and came back to my home and took my pool equipment (roughly $4000 worth). I attempted to speak with the owner of the company but he refuses to speak with me.

The customer's, [member name removed], contract was cancelled as a result of many defaults within several parts of the signed contract including non-payment. Before a decision was made to cancel this contract many opportunities were given to the customer to satisfy him. [member name removed]t was out of the county during this entire project leaving his wife [member name removed] to oversee this project. [member name removed] was present during the entire project every day approving all work that was performed. After time would elapse [member name removed], her husband whom is out of the county, would inspect pictures she would email to him. At that time he would send email or make phone calls to change work that was already performed and approved by [member name removed]. This happened several times via email and phone. We tried to work with [member name removed], being out of the country, and with his wife whom was on site daily to make them both happy. Constant changes are not possible without additional expenses being incurred from labor and materials in addition to scheduling conflicts when work was halted and changed multiple times. When initially signing this contract [member name removed] and [member name removed] were both told that we would prefer they wait until he returned from overseas before we begin. They insisted that the pool construction to be started right away. After the materials were ordered, placed on the schedule to be delivered and the company's construction equipment was delivered to the residence on a Thursday to start the construction on the following Monday, we were then notified by email on Sunday evening, (the day before) about wanting to postpone. At that time postponing would have incurred extra cost so they opted to stay on schedule. I tried to work with [member name removed]as long as we stayed current with our payment schedule on the original contract. After being denied for payment several times for two weeks I had no choice but to cancel the contract. I, personally was denied payment after multiple emails, phone calls and three separate visits to the residence where [member name removed] was inside the residence not answering the door. This project had already cost the company a lot of extra time, labor and scheduling problems for our contracts to follow after this job was completed. I also have pictures of the beautiful pool that was installed at their residence with the concrete decking around the pool not being finished. We poured the first colored concrete cantilever border before collecting he fourth payment that was due upon forming this (before it was poured). The second concrete deck was formed up as well but not poured due to default of non-payment. As with any contract the payment schedule agreed to must be maintained or it will be in default. I believe this was a husband / wife disagreement concerning construction choices pertaining to their project. Being in business for over 23 years we have never had to cancel a contract as well as never experienced problems and confusion between the homeowners such as with this situation with [member name removed]and [member name removed] Please let me know if there is a place I may publish their name and contact information so I may warn future contractors and businesses not to get involved with the [member name removed] The balance due for this contract is $5,085.00. As it states in the signed contract Cabana Pool and Spa LLC. has the right to call the total contract plus interest payment due in full upon 90% of the pool's completion which is to be determined by the contractor. Please feel free, for any interested consumers or business owners, to request pictures of the project and copies of multiple email communications regarding the [member name removed] project. I will be more than happy to forward this to you.
